In a significant development in the Delhi excise policy case, the Delhi High Court has stayed the adverse observations made by a trial court against the Central Bureau of Investigation (CBI) while hearing the agency’s challenge to the discharge of several accused persons.
The matter was heard by Justice Swarana Kanta Sharma, who passed an interim order staying the trial court’s remarks against the investigating agency and its officers.
Notice Issued to Accused

The development follows a February 27 order of the Rouse Avenue Court, which discharged 23 accused persons in the alleged corruption case linked to the now-scrapped Delhi Excise Policy 2021–22.
In that order, the trial court had made strong observations against the CBI investigation, stating that the evidence presented by the agency did not establish even a prima facie case.
CBI Challenges Discharge Order
The CBI approached the Delhi High Court with a revision petition arguing that the trial court had conducted an impermissible “mini-trial” while deciding whether charges should be framed.
According to the agency, the trial court improperly examined evidence in detail at a preliminary stage and made unwarranted remarks against investigators.
During the High Court hearing, Solicitor General Tushar Mehta, appearing for the CBI, argued that the remarks could adversely affect related proceedings, particularly the money-laundering investigation being conducted by the Enforcement Directorate (ED).
Court Directs Deferment of Related Proceedings
Justice Sharma also directed the trial court to postpone hearings in the connected money-laundering case until the High Court decides the CBI’s revision petition.
The High Court’s interim order ensures that the trial court’s remarks against the CBI will not influence parallel proceedings linked to the excise policy case.

सीबीआई ने हाईकोर्ट का रुख किया
सीबीआई ने इस आदेश को चुनौती देते हुए दिल्ली हाईकोर्ट में याचिका दायर की और कहा कि ट्रायल कोर्ट ने चार्ज तय करने के चरण में ही “मिनी-ट्रायल” कर दिया, जो कानून के अनुरूप नहीं है।
एजेंसी का कहना है कि ट्रायल कोर्ट ने साक्ष्यों का अत्यधिक मूल्यांकन करते हुए जांच अधिकारियों के खिलाफ अनावश्यक टिप्पणियां कीं।
संबंधित मामलों की सुनवाई स्थगित
हाईकोर्ट ने यह भी निर्देश दिया कि इस मामले से जुड़े मनी लॉन्ड्रिंग केस की सुनवाई फिलहाल स्थगित रखी जाए, जब तक कि हाईकोर्ट सीबीआई की याचिका पर अंतिम निर्णय नहीं ले लेता।
