The Delhi High Court has granted bail to two men accused of propagating ISIS ideology and radicalising youth under the stringent provisions of the Unlawful Activities (Prevention) Act (UAPA), noting that they had already spent over four years in jail without conclusion of trial.

The order was passed by a Division Bench of Justice Navin Chawla and Justice Ravinder Dudeja, which allowed the appeals filed by the accused challenging the denial of bail by the trial court.

The case relates to allegations that the accused were involved in online propaganda supporting extremist organisations like ISIS and were part of certain social media groups allegedly used to spread radical content and influence youth towards jihadist ideology.

While considering the bail plea, the Court emphasized that prolonged incarceration without trial raises serious concerns under Article 21 (right to personal liberty). It observed that keeping individuals in custody for an extended period, especially when the trial is unlikely to conclude soon, would be unjustified.

The Bench further noted that the role attributed to the accused was limited, and there was no clear allegation that they had created or actively managed the groups through which such content was allegedly circulated.

Importantly, the Court held that mere possession of material on digital devices, even if it appears to propagate anti-national or extremist ideology, cannot by itself justify continued detention for years during trial.

The judges also highlighted the need to distinguish between ideological inclination and actual participation in terrorist activities, observing that such a distinction is crucial while applying the stringent bail provisions under UAPA.

At the same time, the Court clarified that the grant of bail does not amount to an acquittal or a finding on the merits of the case, and the trial will proceed independently.

This ruling is significant as it reiterates that even in serious offences under special laws like UAPA, pre-trial detention cannot be indefinite, and courts must balance the gravity of allegations with constitutional guarantees of personal liberty and speedy trial.

Delhi High Court ने एक महत्वपूर्ण फैसले में ISIS विचारधारा के प्रचार के आरोप में UAPA के तहत गिरफ्तार दो आरोपियों को जमानत दे दी, यह देखते हुए कि वे लगभग चार वर्षों से जेल में थे और मुकदमा अभी तक पूरा नहीं हुआ था।

यह आदेश Justice Navin Chawla और Justice Ravinder Dudeja की खंडपीठ ने पारित किया, जिसने ट्रायल कोर्ट द्वारा जमानत खारिज किए जाने के आदेश को चुनौती देने वाली अपील को स्वीकार किया।

अदालत ने यह भी पाया कि आरोपियों की भूमिका सीमित थी और यह स्पष्ट नहीं था कि उन्होंने स्वयं ऐसे समूह बनाए या सक्रिय रूप से उनका संचालन किया।

महत्वपूर्ण रूप से, अदालत ने कहा कि डिजिटल डिवाइस में मिले कथित आपत्तिजनक या राष्ट्र-विरोधी सामग्री मात्र के आधार पर लंबे समय तक जेल में रखना उचित नहीं है।

अदालत ने यह भी स्पष्ट किया कि केवल वैचारिक झुकाव और वास्तविक आतंकी गतिविधियों में भागीदारी के बीच अंतर करना आवश्यक है, विशेषकर UAPA जैसे कठोर कानूनों के तहत।

साथ ही, अदालत ने स्पष्ट किया कि जमानत दिए जाने का अर्थ यह नहीं है कि आरोपियों को दोषमुक्त कर दिया गया है, बल्कि मुकदमा आगे जारी रहेगा।

यह निर्णय महत्वपूर्ण है क्योंकि यह दर्शाता है कि गंभीर आरोपों के मामलों में भी अनिश्चितकाल तक ट्रायल से पहले हिरासत में रखना उचित नहीं है, और अदालतों को व्यक्तिगत स्वतंत्रता और न्यायिक संतुलन बनाए रखना आवश्यक है।
