Punjab & Haryana High Court denies bail to YouTuber Jyoti Malhotra accused of spying for Pakistan

The Punjab and Haryana High Court has rejected the bail plea of YouTuber and travel influencer Jyoti Malhotra, who has been accused of passing sensitive information to Pakistani intelligence operatives.

The order was passed by Justice Surya Pratap Singh, who observed that there was prima facie evidence indicating Malhotra’s involvement in offences under the Official Secrets Act. The Court said that the material collected by investigators raised a presumption against the accused under Section 4 of the Official Secrets Act, making it inappropriate to grant bail at this stage.

Allegations against the YouTuber

According to the prosecution, Malhotra allegedly shared sensitive information with individuals linked to Pakistan’s intelligence network. Investigators claimed that electronic evidence suggested she had attempted to delete conversations and data relating to communications with such operatives.

Authorities also pointed to a confessional statement attributed to Malhotra, which reportedly led to the discovery of additional facts relevant to the investigation.

Malhotra, a social media influencer from Haryana, was arrested in May 2025 under provisions of the Official Secrets Act and the Bharatiya Nyaya Sanhita (BNS) in connection with the espionage allegations.

Prosecution’s case

Investigators allege that Malhotra maintained contact with Pakistani intelligence-linked individuals and used digital platforms and encrypted messaging applications to communicate with them. The investigation also examined her social media activities, electronic devices, and financial transactions.

The prosecution argued that the case involved serious national security concerns, and releasing the accused on bail could interfere with the ongoing investigation.

Defence arguments

During the hearing, Malhotra’s counsel argued that the prosecution case was based on an exaggerated narrative without concrete evidence of sharing classified information.

The defence also contended that merely maintaining contact with Pakistani nationals or visiting Pakistan does not automatically constitute an offence under espionage laws.

Additionally, regarding allegations that Malhotra took photographs of Pandoh Dam, the defence submitted that the location was not a prohibited area and that photographs of the dam were already available in the public domain.

Court’s reasoning

While denying bail, the High Court noted that the prosecution had placed sufficient material suggesting the transmission of sensitive information and attempts to destroy digital evidence.

Given the seriousness of the allegations and the presumption under the Official Secrets Act, the Court held that the case did not warrant granting bail at this stage of the proceedings.

Background of the case

Malhotra runs a travel channel titled “Travel with JO”, where she posts travel-related content. Investigators have claimed that she had been in contact with Pakistani intelligence-linked individuals since 2023 and had visited Pakistan multiple times.

The case emerged amid heightened tensions between India and Pakistan, shortly after India expelled a Pakistani High Commission official over espionage allegations.

जांच एजेंसियों ने यह भी दावा किया कि उन्होंने इन लोगों के साथ हुई बातचीत से संबंधित डिजिटल डेटा को हटाने की कोशिश की थी।

उनके मोबाइल फोन, लैपटॉप, सोशल मीडिया गतिविधियों और बैंक खातों की जांच की गई है।

अभियोजन ने अदालत में कहा कि यह मामला राष्ट्रीय सुरक्षा से जुड़ा हुआ है, इसलिए आरोपी को जमानत देने से जांच प्रभावित हो सकती है।

बचाव पक्ष की दलील

बचाव पक्ष ने अदालत में तर्क दिया कि अभियोजन का पूरा मामला कल्पनात्मक कहानी पर आधारित है और ऐसा कोई ठोस प्रमाण नहीं है कि मल्होत्रा ने वास्तव में कोई गोपनीय जानकारी साझा की हो।

वकील ने यह भी कहा कि पाकिस्तान की यात्रा करना या वहां के अधिकारियों से संपर्क रखना अपने आप में अपराध नहीं है।

इसके अलावा, पंडोह डैम की तस्वीरें लेने के आरोप पर बचाव पक्ष ने कहा कि यह प्रतिबंधित क्षेत्र नहीं है और उसकी तस्वीरें पहले से सार्वजनिक रूप से उपलब्ध हैं।

अदालत का निर्णय

अदालत ने कहा कि जांच एजेंसियों द्वारा प्रस्तुत सामग्री से संवेदनशील जानकारी के आदान-प्रदान और डिजिटल साक्ष्यों को मिटाने की कोशिश के संकेत मिलते हैं।

इन परिस्थितियों और Official Secrets Act के तहत लागू कानूनी अनुमान को देखते हुए अदालत ने जमानत याचिका खारिज कर दी।
