Supreme Court Emphasizes Police Duty to Uphold Constitutional Ideals in Free Speech Case

The Court's remarks were made in the context of quashing an FIR filed by the Gujarat Police against Congress Rajya Sabha MP Imran Pratapgarhi for a controversial Instagram post featuring a video clip with a poem "Ae khoon ke pyase baat suno" in the background.

Court's Interpretation of Constitutional Duty for Police Officers

The bench, comprising Justice Abhay Oka and Justice Ujjal Bhuyan, emphasized that police officers, as part of the State under Article 12 of the Constitution, are bound by constitutional values. They are expected to uphold the ideals of the Constitution, which are enshrined in the Preamble. The right to liberty of thought, expression, belief, and faith is considered a core ideal of the Constitution, and it is the duty of law enforcement to protect these rights.

The Court observed, “The police officers must abide by the Constitution and respect its ideals. Liberty of thought and expression is one of the ideals of our Constitution.”

Fundamental Right to Freedom of Speech

The Court reaffirmed the fundamental right to freedom of speech and expression guaranteed under Article 19(1)(a) of the Constitution, stating that the police, as part of the State, are responsible for ensuring that citizens can exercise their constitutional rights without interference.

The case arose from an FIR registered in Jamnagar, Gujarat, against Imran Pratapgarhi under multiple sections of the Bharatiya Nyaya Sanhita (BNS). The Court noted that, while the alleged offenses under Sections 196, 197, 299, and 302 of the BNS were serious, the alleged violations related to speech and expression should have been treated differently.

The Court observed that for offenses related to speech and expression, police officers should have conducted a preliminary inquiry under Section 173(3) of the BNS, which allows a police officer the discretion to conduct an inquiry before filing an FIR. Since the officer did not exercise this option, the Court found that the FIR was prematurely registered, violating the constitutional right to free expression.

The Role of Reasonable Restrictions on Free Speech

The Supreme Court emphasized that Article 19(2) allows the State to impose reasonable restrictions on the freedom of speech and expression in the interest of public order, decency, and morality, among other grounds. However, the Court stressed that any such restrictions must be reasonable and cannot be arbitrary, oppressive, or fanciful.

The Court made it clear that even when restrictions on free speech are warranted, the primary right to express one’s thoughts freely must always be protected unless the restrictions meet the criteria of reasonableness under Article 19(2).
