SC Grants Bail to Father of Minor Accused in Pune Porsche Crash Blood-Sample Tampering Case

The Supreme Court of India has granted bail to Vishal Agarwal, the father of the minor accused in the Pune Porsche crash case, who is alleged to have conspired to swap blood samples to shield his son from legal consequences after a fatal accident in 2024.

A Bench comprising Justice B.V. Nagarathna and Justice Ujjal Bhuyan passed the order after noting that the accused had already spent a considerable period in custody.

The case arises from a fatal car crash that occurred on May 19, 2024, in Pune’s Kalyani Nagar area, where a Porsche car allegedly driven by a 17-year-old minor crashed into a motorcycle, killing two IT professionals.

Investigators claimed that he arranged for the minor’s blood sample to be replaced with another sample so that the forensic report would show “nil alcohol” levels, thereby protecting the minor from charges related to drunken driving.

Police alleged that hospital staff and other individuals were involved in the conspiracy to manipulate medical evidence at Sassoon General Hospital, where the blood tests were conducted.

Supreme Court’s Order

While granting bail, the Supreme Court observed that:

• The accused had already been in custody for around 22 months.
• Other co-accused persons in the case had been granted bail earlier.

Taking these factors into account, the Court held that the father had made out a case for bail.

पुणे पोर्शे दुर्घटना मामले में नाबालिग आरोपी के पिता को सुप्रीम कोर्ट से जमानत

सुप्रीम कोर्ट ने पुणे पोर्शे दुर्घटना मामले में नाबालिग आरोपी के पिता विशाल अग्रवाल को जमानत दे दी है।

उन पर आरोप है कि उन्होंने दुर्घटना के बाद रक्त नमूनों की अदला-बदली (blood sample swap) की साजिश रची, ताकि उनके बेटे के खिलाफ शराब पीकर गाड़ी चलाने का आरोप सिद्ध न हो सके।

यह आदेश न्यायमूर्ति बी.वी. नागरत्ना और न्यायमूर्ति उज्जल भुइयां की पीठ ने पारित किया।

दुर्घटना की पृष्ठभूमि

यह मामला 19 मई 2024 को पुणे के कल्याणी नगर क्षेत्र में हुई एक भीषण सड़क दुर्घटना से जुड़ा है।

आरोप है कि 17 वर्षीय नाबालिग ने तेज रफ्तार पोर्शे कार चलाते हुए मोटरसाइकिल को टक्कर मार दी, जिसमें दो आईटी पेशेवरों की मृत्यु हो गई।

पुलिस ने आरोप लगाया कि ससून जनरल अस्पताल के कुछ डॉक्टरों और अन्य लोगों की मदद से यह साजिश रची गई थी।

सुप्रीम कोर्ट का आदेश

सुप्रीम कोर्ट ने जमानत देते हुए कहा कि:

• आरोपी करीब 22 महीनों से जेल में है
• मामले के अन्य सह-आरोपियों को भी पहले ही जमानत मिल चुकी है।

अदालत ने कुछ शर्तों के साथ जमानत दी:

• आरोपी गवाहों से सीधे या परोक्ष रूप से संपर्क नहीं करेगा
• शर्तों का उल्लंघन होने पर जमानत रद्द की जा सकती है
• ट्रायल कोर्ट को मामले की सुनवाई शीघ्र पूरी करने का निर्देश दिया गया है।
