Uttarakhand High Court Rejects Petition Against Uniform Civil Code’s Provisions on Live-In Relationships

In a recent development, the Uttarakhand High Court strongly rebuked a 23-year-old petitioner’s challenge against the provisions of the Uniform Civil Code (UCC) in the state, which mandates the registration of live-in relationships. The bench, comprising Chief Justice G Narendar and Justice Alok Mahra, questioned the petitioner’s concerns regarding privacy, asserting that live-in relationships are not secretive and are often known to neighbors and society.

Court's Strong Remarks on Privacy Concerns

During the hearing, the bench remarked, “What is the secret? Both of you are living together; your neighbor knows, society knows, and the world knows. Then where is the secrecy you are talking about?... What gossip? Are you living secretly, in some secluded cave?” The court was responding to the petition filed by Jai Tripathi, who argued that the UCC provisions intruded on his personal liberty and privacy by requiring the registration of live-in relationships. The court’s remarks emphasized that the issue of privacy in this case was unfounded, especially as live-in relationships are generally not hidden from the public eye.

Uttarakhand's Uniform Civil Code and Its Implications

• The UCC, which Uttarakhand became the first state to enact on January 27, aims to establish a uniform legal framework for marriage, divorce, property, inheritance, and adoption laws for all residents of the state. Among the clauses, one significant provision mandates the registration of live-in relationships. Tripathi, who challenged the provision, contended that this requirement would institutionalize gossip and intrude on personal choices.
• However, the bench clarified that the state is not prohibiting live-in relationships, but rather is facilitating their registration. The court questioned the petitioner’s allegations, urging him to provide specific evidence if he felt that his privacy was truly being invaded.

Registration Requirement for Live-In Relationships

• The UCC enforces the registration of live-in relationships to ensure that such relationships are legally recognized. Failure to declare live-in relationships or providing false information could result in penalties, including imprisonment for up to three months, a fine of Rs 25,000, or both. Additionally, a delay in registration could also incur a fine or imprisonment.
• One of the key provisions of the law is that it also recognizes children born out of live-in relationships as legitimate, ensuring equal inheritance rights for them. The law provides for gender-neutral terminology, referring to both sons and daughters as “children” without differentiation, thus promoting gender equality.

Government’s Support for the UCC

• The Uttarakhand government, led by Chief Minister Pushkar Singh Dhami, has strongly supported the UCC, describing it as an essential step in the country’s development. Dhami remarked that the law was “an offering made by our state in the great ‘yagya’ being performed by the Prime Minister to make the country a developed, organised, harmonious, and self-reliant nation.”
• To make the process easier for residents, the Uttarakhand government has launched an online portal for the registration of marriages, divorces, live-in relationships, and their termination. The portal enables residents to complete these procedures from their mobile phones or desktops, with progress updates available via email or SMS.
