Supreme Court Orders Compensation in Air India Case Based on Pranay Sethi Guidelines

The Supreme Court has directed compensation in the case of Trivedi Kodkany v. Air India Ltd, grounding its decision on the compensation computation principles laid down in National Insurance Company Ltd v. Pranay Sethi. The Court took into account the income of the deceased employee, based on the entitlement.

Landmark Judgment in Pranay Sethi: Framework for Compensation

In the Pranay Sethi judgment, a Constitution Bench of five judges laid down guidelines for determining future prospects while awarding compensation in motor accident claims.

Future Prospects Based on Age and Employment Type

The Court held that when calculating income for compensation:

  • An addition of 50% of the actual salary should be made where the deceased had a permanent job and was below the age of 40 years.

  • The addition is reduced to 30% if the deceased was between 40 and 50 years, and 15% if between 50 and 60 years.

For individuals who were self-employed or earning a fixed salary, the Court prescribed:

  • A 40% addition if the deceased was under 40,

  • 25% for ages 40–50, and

  • 10% for those between 50 and 60 years.

Fixed Compensation for Non-Economic Damages

The Court further clarified fixed amounts for non-pecuniary losses:

  • Loss of estate: ₹15,000

  • Loss of consortium: ₹40,000

  • Funeral expenses: ₹15,000

These amounts are to be enhanced by 10% every three years to account for inflation and changing economic circumstances.

Deductions for Personal and Living Expenses

The Pranay Sethi judgment followed the precedent set in Sarla Verma & Ors v. Delhi Transport Corporation (2009). It held that:

  • If the deceased was married, 1/3rd of the income should be deducted towards personal and living expenses.

  • If there were 2 to 3 dependents, the deduction should be 1/4th.

  • For 4 to 5 dependents, it should be 1/5th.

The Court also noted that different deduction rates apply if the deceased was a bachelor. In the Trivedi case, the Supreme Court clarified that the term “permanent job” is not restricted only to government employees or industrial workers protected under statutory provisions. This broader interpretation extends compensation benefits to a wider class of working individuals.

Compensation Paid by Air India

In the incident under consideration, Air India paid ₹40 lakhs to the parents of the deceased and ₹4 crores to the surviving spouse and two children. As for the Air India crew, compensation will be disbursed as per their employment contracts, including provisions under the carrier’s insurance policy.
