Supreme Court Grants Bail To Suspended Ranchi Deputy Commissioner Chhavi Ranjan in Army Land Scam Case

The Top Court notes lengthy trial period, lack of criminal antecedents, and co-accused already on bail

The Supreme Court of India today granted bail to Chhavi Ranjan, the suspended Deputy Commissioner of Ranchi, who was arrested in connection with the Jharkhand Army Land Scam case involving allegations of money laundering.

A Bench of Justice Surya Kant and Justice N. Kotiswar Singh allowed the bail petition, challenging an earlier order of the Jharkhand High Court which had denied him relief. Ranjan has been in judicial custody since his arrest on May 4, 2023.

Grounds for Granting Bail

The Supreme Court, in its order, took into consideration several factors while granting bail, emphasizing that the decision was made without expressing any opinion on the nature of the allegations against the accused.

The primary reasons cited by the Bench were:

1. Period of Custody: The substantial time already spent by the petitioner in jail since May 2023.

2. Trial Commencement: The fact that the complaint has been filed, and the trial has commenced, with 5 out of 31 witnesses already examined.

3. Lengthy Trial: The Court noted that the "Conclusion of trial will take some time," indicating a long wait for the final verdict.

4. Co-accused Status: The observation that co-accused have already been released on bail was a key consideration.

5. No Criminal Antecedents: The petitioner does not have any prior criminal record.

6. No Likelihood of Tampering: The Court found no likelihood of the petitioner influencing witnesses or tampering with the evidence.

Allegations and Conditions of Bail

Allegations: Chhavi Ranjan is accused of having conspired with and assisted the main accused in fabricating records of certain land holdings, including a portion of Army land in Ranchi, with the view to avail loan facilities and illegal transfer. The case is being investigated under the provisions of the Prevention of Money Laundering Act (PMLA).

Bail Conditions: The Supreme Court imposed strict conditions to ensure his cooperation and attendance:

• He shall furnish bail bonds to the satisfaction of the trial court.

• The petitioner shall not leave the State of Jharkhand without the prior permission of the trial court.

• He shall remain present before the trial court on each and every date.

• He shall fully cooperate for the timely completion of the pending proceedings.

The Court warned that any attempt to misuse the concession of bail, such as influencing witnesses, would result in the cancellation of his bail.

भारत के सर्वोच्च न्यायालय ने आज रांची के निलंबित उपायुक्त छवि रंजन को जमानत दे दी। रंजन की गिरफ्तारी झारखंड सेना भूमि घोटाला मामले से जुड़ी थी, जिसमें उन पर मनी लॉन्ड्रिंग के आरोप लगे थे।

न्यायमूर्ति सूर्यकांत और न्यायमूर्ति एन. कोटिश्वर सिंह की पीठ ने उनकी जमानत याचिका स्वीकार कर ली। यह याचिका झारखंड उच्च न्यायालय के एक आदेश को चुनौती देती थी, जिसने उन्हें जमानत देने से इनकार कर दिया था। रंजन 4 मई, 2023 को गिरफ्तारी के बाद से ही न्यायिक हिरासत में थे।

जमानत देने के आधार

सुप्रीम कोर्ट ने जमानत देते समय कई कारकों पर विचार किया और जोर दिया कि यह निर्णय आरोपी के खिलाफ आरोपों की प्रकृति पर कोई राय व्यक्त किए बिना लिया गया है।

पीठ द्वारा बताए गए मुख्य कारण निम्नलिखित थे:

1. हिरासत की अवधि: याचिकाकर्ता द्वारा मई 2023 से जेल में बिताया गया पर्याप्त समय।

2. ट्रायल की शुरुआत: शिकायत दर्ज होने और ट्रायल शुरू होने के बावजूद, 31 में से केवल 5 गवाहों की ही अब तक जांच हो पाई है।

3. लंबा ट्रायल: न्यायालय ने कहा कि "ट्रायल के निष्कर्ष में कुछ समय लगेगा," जो अंतिम फैसले के लिए एक लंबी प्रतीक्षा अवधि का संकेत देता है।

4. सह-आरोपियों की स्थिति: यह महत्वपूर्ण अवलोकन कि सह-आरोपियों को पहले ही जमानत पर रिहा किया जा चुका है।

5. कोई आपराधिक इतिहास नहीं: याचिकाकर्ता का कोई पूर्व आपराधिक रिकॉर्ड नहीं है।

6. गवाहों को प्रभावित करने की संभावना नहीं: कोर्ट ने पाया कि याचिकाकर्ता द्वारा गवाहों को प्रभावित करने या सबूतों के साथ छेड़छाड़ करने की कोई संभावना नहीं है।

आरोप और जमानत की शर्तें

आरोप: छवि रंजन पर मुख्य आरोपी के साथ मिलकर रांची में सेना की भूमि सहित कुछ भूमि होल्डिंग्स के रिकॉर्ड में हेरफेर करने और अवैध ऋण सुविधाओं और हस्तांतरण के लिए साजिश रचने और सहायता करने का आरोप है। मामले की जांच धन शोधन निवारण अधिनियम (PMLA) के प्रावधानों के तहत की जा रही है।

जमानत की शर्तें: सुप्रीम कोर्ट ने उनके सहयोग और उपस्थिति सुनिश्चित करने के लिए सख्त शर्तें लगाईं:

• उन्हें ट्रायल कोर्ट की संतुष्टि के अनुसार जमानत बांड प्रस्तुत करना होगा।

• याचिकाकर्ता ट्रायल कोर्ट की पूर्व अनुमति के बिना झारखंड राज्य छोड़कर नहीं जाएंगे।

• उन्हें ट्रायल कोर्ट के समक्ष प्रत्येक तारीख पर उपस्थित रहना होगा।

• वह लंबित कार्यवाही को समय पर पूरा करने के लिए पूरा सहयोग करेंगे।

न्यायालय ने चेतावनी दी कि जमानत की रियायत का दुरुपयोग करने का कोई भी प्रयास, जैसे कि गवाहों को प्रभावित करना, उनकी जमानत को रद्द करने का कारण बन सकता है।
