Delhi High Court To Order Takedown Of Deepfake Videos Showing Shashi Tharoor Praising Pakistan

The Delhi High Court on May 8 indicated that it would pass orders directing the removal of AI-generated deepfake videos falsely depicting Congress MP Shashi Tharoor praising Pakistan and making politically sensitive statements.

Justice Mini Pushkarna made the observation while hearing a civil suit filed by Tharoor seeking protection of his personality rights and immediate removal of the allegedly fabricated videos circulating on social media platforms.


Court Issues Summons To Centre, Meta & X

The Court issued summons to:

  • Union Government,
  • Meta,
  • X (formerly Twitter),
  • and other social media intermediaries

in response to Tharoor’s plea seeking protection against misuse of his image, voice, likeness, and public identity through artificial intelligence-generated content.

During the hearing, Justice Mini Pushkarna orally remarked:

“Orders will be passed.”

The Court also directed the respondents to file their replies within four weeks.


What Did Shashi Tharoor Allege?

In his suit before the Delhi High Court, Shashi Tharoor alleged that unknown persons had orchestrated a malicious disinformation campaign using AI tools and machine learning technologies to generate hyper-realistic deepfake videos.

According to the plea:

  • his face,
  • voice,
  • speaking style,
  • and mannerisms

were cloned using artificial intelligence to create fabricated videos portraying him as praising Pakistan’s diplomacy and foreign policy.

The videos allegedly attributed statements to him such as:

  • “Pakistan is faring much better diplomatically than India”
  • and praising Pakistan’s diplomatic strategy as “absolute brilliance.”

Tharoor contended that he never made such statements.


Tharoor Says Videos Harmed His Reputation & India’s Image

The suit stated that the deepfake videos were so realistic that:

  • members of the public,
  • journalists,
  • political observers,
  • and even foreign media persons

were allegedly deceived into believing them to be genuine.

Tharoor argued that the campaign caused:

  • serious reputational damage,
  • mental anguish,
  • harassment,
  • and harm to his public standing.

He also claimed that the circulation of such content during the Kerala elections was a deliberate attempt to interfere with democratic processes and damage his patriotic credentials.


Senior Advocate Amit Sibal’s Submissions

Senior Advocate Amit Sibal, appearing for Tharoor, told the Court that despite complaints to authorities and multiple fact-checks proving the videos were fake, the videos continued resurfacing online through different URLs and accounts.

He argued that:

  • deepfakes could be misused by foreign governments,
  • false statements attributed to Tharoor could damage India’s image internationally,
  • and the misuse of AI technology posed a serious threat to personality rights and democratic discourse.

Sibal reportedly told the Court:

“They keep coming back like ten heads of Ravana.”

He further submitted that Tharoor’s identity had been misappropriated to create politically sensitive content without consent.


Meta Says Some Links Already Removed

During the proceedings, counsel appearing for Meta informed the Court that some of the URLs identified by Tharoor had already been removed from Instagram and were inaccessible.

However, Tharoor’s legal team argued that the content repeatedly resurfaced through new accounts and URLs, requiring judicial intervention for comprehensive removal and future restraint orders.


Growing Judicial Concern Over Deepfakes & Personality Rights

The case adds to the growing number of matters before Indian courts involving:

  • AI-generated deepfakes,
  • misuse of celebrity identities,
  • and violation of personality rights.

In recent years, the Delhi High Court has passed protective orders in favour of several public figures, including:

  • Amitabh Bachchan,
  • Anil Kapoor,
  • Bhuvan Bam,
  • and Senior Advocate Vikas Pahwa,

restraining unauthorized use of their names, images, voices, and likenesses online.

Courts have increasingly recognised that AI-generated impersonation and deepfake technology can seriously harm:

  • individual reputation,
  • public trust,
  • privacy,
  • and democratic discourse.

Personality Rights & Indian Law

Although India does not yet have a standalone legislation specifically regulating deepfakes, courts have increasingly protected “personality rights” under:

  • Article 21 of the Constitution,
  • right to privacy,
  • publicity rights,
  • and intellectual property principles.

Legal experts believe the Tharoor case could become another important precedent concerning:

  • AI regulation,
  • online misinformation,
  • platform liability,
  • and protection against synthetic media impersonation.

Case Filed Through Trilegal

The suit was filed through advocate Nikhil Narendran, partner at law firm Trilegal.

The Delhi High Court is expected to pass detailed interim directions regarding removal of the impugned videos and protection of Tharoor’s personality rights in the coming days.

दिल्ली हाई कोर्ट ने 8 मई को संकेत दिया कि वह AI-generated deepfake videos हटाने के आदेश पारित करेगा, जिनमें Congress सांसद Shashi Tharoor को पाकिस्तान की प्रशंसा करते और राजनीतिक रूप से संवेदनशील बयान देते हुए दिखाया गया है।

Justice Mini Pushkarna ने यह टिप्पणी उस सिविल मुकदमे की सुनवाई के दौरान की, जो थरूर ने अपने personality rights की सुरक्षा तथा कथित फर्जी वीडियो हटाने की मांग करते हुए दायर किया है।


केंद्र सरकार, Meta और X को नोटिस

कोर्ट ने:

  • Union Government,
  • Meta,
  • X (पूर्व Twitter),
  • तथा अन्य सोशल मीडिया intermediaries

को समन जारी किया।

सुनवाई के दौरान Justice Mini Pushkarna ने कहा:

“Orders will be passed.”

कोर्ट ने प्रतिवादियों को चार सप्ताह के भीतर जवाब दाखिल करने का निर्देश दिया।


शशि थरूर ने क्या आरोप लगाए?

Shashi Tharoor ने अपनी याचिका में आरोप लगाया कि अज्ञात व्यक्तियों ने artificial intelligence और machine learning तकनीकों का उपयोग करके उनके deepfake videos तैयार किए।

याचिका के अनुसार:

  • उनका चेहरा,
  • आवाज,
  • बोलने का तरीका,
  • तथा हावभाव

AI की सहायता से क्लोन किए गए।

इन वीडियो में उन्हें पाकिस्तान की विदेश नीति और कूटनीति की प्रशंसा करते हुए दिखाया गया।

याचिका में कहा गया कि वीडियो में उन्हें यह कहते दिखाया गया:

  • “Pakistan is faring much better diplomatically than India”
  • तथा पाकिस्तान की रणनीति को “absolute brilliance” बताया गया।

थरूर ने कहा कि उन्होंने कभी ऐसे बयान नहीं दिए।


प्रतिष्ठा और भारत की छवि को नुकसान का आरोप

याचिका में कहा गया कि deepfake videos इतने वास्तविक प्रतीत हो रहे थे कि:

  • आम लोग,
  • पत्रकार,
  • राजनीतिक विश्लेषक,
  • तथा विदेशी मीडिया

भी भ्रमित हो गए।

थरूर ने कहा कि इन वीडियो से:

  • उनकी प्रतिष्ठा को नुकसान पहुंचा,
  • मानसिक पीड़ा हुई,
  • सार्वजनिक छवि प्रभावित हुई,
  • तथा भारत की छवि पर भी असर पड़ सकता है।

उन्होंने यह भी कहा कि Kerala चुनावों के दौरान इस प्रकार की सामग्री का प्रसार लोकतांत्रिक प्रक्रिया को प्रभावित करने का प्रयास था।


Senior Advocate अमित सिब्बल की दलीलें

Senior Advocate Amit Sibal ने कोर्ट को बताया कि शिकायतों और fact-checks के बावजूद deepfake videos बार-बार अलग URLs के माध्यम से फिर से अपलोड किए जा रहे हैं।

उन्होंने कहा कि:

  • foreign governments भी इन videos का दुरुपयोग कर सकती हैं,
  • इससे भारत की अंतरराष्ट्रीय छवि प्रभावित हो सकती है,
  • और AI आधारित deepfakes लोकतांत्रिक व्यवस्था के लिए खतरा हैं।

उन्होंने कोर्ट में कहा:

“They keep coming back like ten heads of Ravana.”


Meta ने कहा कुछ Links हटाए गए

Meta की ओर से पेश वकील ने कोर्ट को बताया कि थरूर द्वारा चिन्हित कुछ Instagram URLs पहले ही हटाए जा चुके हैं और अब उपलब्ध नहीं हैं।
