“AI May Assist, But Only More Judges Can Match Exploding Supreme Court Filings”: Justice Dipankar Datta

Justice Dipankar Datta of the Supreme Court of India has observed that while Artificial Intelligence (AI) can assist judges and lawyers in certain areas, it cannot substitute the need for more judges to address the rapidly increasing number of cases before the apex court.

Speaking at a panel discussion titled “Law, Lawyers, and AI: The Next Frontier” organised by the Supreme Court Advocates-on-Record Association, Justice Datta highlighted the sharp rise in Supreme Court filings over the years. He pointed out that annual filings have nearly doubled from around 40,000 cases in 2018 to approximately 75,000 at present, while the sanctioned strength of judges has remained unchanged.

Justice Datta emphasised that AI can be a helpful tool for tasks such as legal research, drafting assistance and refining judicial language, but the core constitutional function of adjudication must remain with human judges. According to him, judicial decision-making requires an understanding of human conduct, intentions and motivations, which machines are incapable of fully comprehending.

He observed that judges are required to assess human emotions and impulses such as violence, greed, lust and anger while deciding cases. These are complex human elements that cannot be evaluated by artificial intelligence, making human judges indispensable in the justice delivery system.

Justice Datta also shared his personal experience with the limited use of AI. He stated that while he does use AI tools for research and polishing language, the final analytical work must always be done by the judge. He remarked that what a judge writes independently is always the best product.

Illustrating the limits of technology, Justice Datta recounted instances where he had dictated orders in open court but later chose not to sign them after re-examining the case files. He said such instinctive judicial self-correction is difficult for AI systems to replicate.

The judge also issued a caution to members of the legal profession regarding the ethical use of AI. He warned that the trust between the bar and the bench is fragile and could be severely damaged if lawyers rely on AI-generated content without proper verification before presenting it in court.

Justice Datta further suggested that AI could be more effectively deployed in administrative functions, particularly within the Supreme Court registry, to improve classification of cases such as bail matters, which are often inadequately segregated at present.

 

He concluded by stating that AI should remain a servant to the legal system and not its master. Referring to the risks of uploading sensitive information to public AI platforms, he cautioned against compromising confidentiality. While AI may continue to evolve, he said, the moral courage required of judges and lawyers can never be replaced by machines.

सुप्रीम कोर्ट के न्यायमूर्ति दीपंकर दत्ता ने कहा है कि कृत्रिम बुद्धिमत्ता (AI) न्यायिक कार्यों में सहायक हो सकती है, लेकिन सुप्रीम कोर्ट में तेजी से बढ़ रहे मामलों से निपटने के लिए अधिक न्यायाधीशों की आवश्यकता को यह पूरा नहीं कर सकती।

वे “Law, Lawyers, and AI: The Next Frontier” विषय पर आयोजित एक पैनल चर्चा में बोल रहे थे, जिसका आयोजन सुप्रीम कोर्ट एडवोकेट्स-ऑन-रिकॉर्ड एसोसिएशन द्वारा किया गया था। न्यायमूर्ति दत्ता ने बताया कि वर्ष 2018 में सुप्रीम कोर्ट में लगभग 40,000 मामले दर्ज हुए थे, जबकि अब यह संख्या बढ़कर लगभग 75,000 हो गई है, वहीं न्यायाधीशों की स्वीकृत संख्या वर्षों से अपरिवर्तित बनी हुई है।

उन्होंने कहा कि AI कानूनी शोध, मसौदा तैयार करने और भाषा सुधार जैसे कार्यों में सहायक हो सकता है, लेकिन निर्णय देने की मूल संवैधानिक जिम्मेदारी केवल मानव न्यायाधीश ही निभा सकते हैं। न्यायिक निर्णय-प्रक्रिया में मानवीय आचरण और मानसिकता की समझ आवश्यक होती है, जिसे मशीनें पूरी तरह नहीं समझ सकतीं।

न्यायमूर्ति दत्ता ने कहा कि न्यायाधीशों को हिंसा, लालच, कामना और क्रोध जैसी मानवीय प्रवृत्तियों का मूल्यांकन करना पड़ता है। ये ऐसे जटिल मानवीय तत्व हैं जिनका आकलन AI नहीं कर सकता।

उन्होंने AI के अपने सीमित उपयोग का भी उल्लेख किया और कहा कि वे शोध और भाषा सुधार के लिए इसका उपयोग करते हैं, लेकिन अंतिम विश्लेषण स्वयं करते हैं। उन्होंने कहा कि न्यायाधीश द्वारा स्वयं लिखा गया निर्णय ही सर्वोत्तम होता है।

AI की सीमाओं को रेखांकित करते हुए उन्होंने बताया कि कुछ अवसरों पर उन्होंने खुले न्यायालय में आदेश डिक्टेट किए, लेकिन बाद में फाइलों की पुनः जाँच के बाद उन पर हस्ताक्षर नहीं किए। उन्होंने कहा कि इस प्रकार की न्यायिक आत्म-समीक्षा AI के लिए कठिन है।

न्यायमूर्ति दत्ता ने अधिवक्ताओं को AI के नैतिक उपयोग के प्रति भी आगाह किया। उन्होंने कहा कि बार और बेंच के बीच विश्वास अत्यंत संवेदनशील होता है और बिना सत्यापन के AI-जनित सामग्री प्रस्तुत करना इस विश्वास को नुकसान पहुँचा सकता है।

उन्होंने यह भी सुझाव दिया कि सुप्रीम कोर्ट रजिस्ट्री में प्रशासनिक स्तर पर AI का बेहतर उपयोग किया जा सकता है, विशेष रूप से जमानत आवेदनों जैसे मामलों के सही वर्गीकरण के लिए।

 

अपने संबोधन के अंत में उन्होंने कहा कि AI को न्याय प्रणाली का सेवक बने रहना चाहिए, स्वामी नहीं। सार्वजनिक AI प्लेटफॉर्म पर संवेदनशील जानकारी अपलोड करने के जोखिमों की ओर संकेत करते हुए उन्होंने सावधानी बरतने की आवश्यकता बताई। उन्होंने स्पष्ट किया कि चाहे AI कितना भी उन्नत क्यों न हो जाए, न्यायाधीशों और वकीलों की नैतिक साहस जैसी मानवीय विशेषताओं का स्थान नहीं ले सकता।
