In a significant move aimed at strengthening India’s judiciary, the Union Cabinet has approved a proposal to increase the sanctioned strength of judges in the Supreme Court of India from 34 to 38 (including the Chief Justice of India).

The decision paves the way for the introduction of the Supreme Court (Number of Judges) Amendment Bill, 2026, which seeks to amend the existing 1956 law governing the apex court’s strength.

What the Cabinet Approved

The Cabinet, chaired by Prime Minister Narendra Modi, cleared the proposal to increase the number of judges by four—from 33 to 37 (excluding the Chief Justice of India). This will take the total strength to 38 judges including the CJI.

The amendment will be introduced in Parliament for approval before it becomes law.

Objective Behind Increasing Judge Strength

The government has stated that the primary aim of increasing the number of judges is to:

  • Improve efficiency of the Supreme Court
  • Reduce pendency of cases
  • Ensure faster delivery of justice

The move is expected to significantly enhance the Court’s capacity to handle its growing caseload.

Legal Framework & Constitutional Basis

Under Article 124(1) of the Constitution of India, Parliament has the authority to determine the number of judges in the Supreme Court.

The strength of the Court has been periodically increased through amendments to the Supreme Court (Number of Judges) Act, 1956, reflecting the growing demands on the judiciary.

Historical Evolution of Judge Strength

The Supreme Court’s strength has expanded over time:

  • 1956: Initially limited to 10 judges (excluding CJI)
  • 1960: Increased to 13
  • 1977: Increased to 17
  • 1986: Increased to 25
  • 2008: Increased to 30
  • 2019: Increased to 33
  • 2026 (Proposed): Increased to 37 (excluding CJI)

Financial Implications

The additional expenditure on salaries, infrastructure, and support staff will be borne from the Consolidated Fund of India, as per the government’s statement.

Why This Move Is Significant

India’s Supreme Court has been grappling with a high volume of pending cases. Increasing judicial strength is seen as a structural reform to:

  • Reduce backlog
  • Improve access to justice
  • Strengthen institutional efficiency

Legal experts view this as a necessary step, though they also emphasize the need for complementary reforms such as procedural efficiency and case management systems.

भारत सरकार ने न्यायपालिका को मजबूत करने की दिशा में एक महत्वपूर्ण कदम उठाते हुए सुप्रीम कोर्ट के न्यायाधीशों की संख्या बढ़ाने के प्रस्ताव को मंजूरी दे दी है।

इस निर्णय के तहत सुप्रीम कोर्ट की कुल स्वीकृत संख्या 34 से बढ़ाकर 38 (मुख्य न्यायाधीश सहित) की जाएगी।

कैबिनेट का निर्णय

प्रधानमंत्री नरेंद्र मोदी की अध्यक्षता में हुई बैठक में Supreme Court (Number of Judges) Amendment Bill, 2026 को संसद में पेश करने की मंजूरी दी गई।

इसमें न्यायाधीशों की संख्या 33 से बढ़ाकर 37 (CJI को छोड़कर) करने का प्रस्ताव है, जिससे कुल संख्या 38 हो जाएगी।

इस निर्णय का उद्देश्य

सरकार के अनुसार इस कदम का उद्देश्य है:

  • सुप्रीम कोर्ट की कार्यक्षमता बढ़ाना
  • लंबित मामलों को कम करना
