Supreme Court to Deliver Judgment tomorrow on Minimum Practice Requirement for Judicial Service Exam

The Supreme Court of India is set to pronounce a crucial judgment on whether a minimum practice requirement should be reinstated as an eligibility condition for entry-level positions in the judicial service. The decision will be delivered by a bench comprising Chief Justice of India BR Gavai, Justice AG Masih, and Justice K Vinod Chandran in the All India Judges Association case.

Historically, most Indian states required candidates to have a minimum of three years’ legal practice to apply for judicial services. However, in 2002, the Supreme Court abolished this condition, allowing fresh law graduates to apply for posts such as Munsiff-Magistrates. This change was based on the belief that newer entrants could be effectively trained post-selection.

Since then, several petitions have sought the reinstatement of the three-year practice mandate, a move supported by many High Courts and legal experts. The Supreme Court had reserved judgment on this issue on January 28, 2025, and had even stayed the recruitment process by the Gujarat High Court, which attempted to proceed without the minimum experience clause.

During hearings, Amicus Curiae and Senior Advocate Siddharth Bhatnagar voiced concerns about the inefficacy of allowing inexperienced graduates into judicial roles. He argued that lack of real courtroom experience could compromise judicial quality. The bench acknowledged these concerns but also debated how effective mandatory practice was in reality, especially if limited to symbolic vakalat work.

Only Sikkim and Chhattisgarh High Courts expressed that the practice requirement need not be reinstated. In contrast, most High Courts and state governments believed that permitting fresh graduates to join the judiciary directly was counter-productive and detrimental to judicial efficiency.

The 2002 Supreme Court ruling in the All India Judges Association case had earlier acknowledged that while requiring three years of practice helped in filtering candidates, the best legal talent was often discouraged from applying due to the delay. The ruling quoted:

"A bright young law graduate after 3 years of practice finds the Judicial Service not attractive enough."

Taking into account the Shetty Commission's recommendations and the Amicus Curiae's submissions, the court in 2002 ruled that it should not be mandatory for an applicant to have three years of practice to enter judicial service. However, it advised that once selected, recruits should undergo training of at least one year, preferably two years, to prepare them for the responsibilities of the role.

न्यायिक सेवा में न्यूनतम प्रैक्टिस अनिवार्यता पर सुप्रीम कोर्ट सुनाएगा फैसला

भारत के सर्वोच्च न्यायालय द्वारा एक महत्वपूर्ण फैसले की घोषणा की जानी है कि क्या न्यायिक सेवा के प्रवेश-स्तर पदों के लिए आवेदन करने हेतु न्यूनतम प्रैक्टिस की अनिवार्यता को फिर से लागू किया जाए। यह निर्णय भारत के मुख्य न्यायाधीश बी. आर. गवई, न्यायमूर्ति ए. जी. मसीह और न्यायमूर्ति के. विनोद चंद्रन की पीठ द्वारा ऑल इंडिया जजेस एसोसिएशन मामले में सुनाया जाएगा।

ऐतिहासिक रूप से, अधिकांश भारतीय राज्यों में यह शर्त थी कि उम्मीदवार को न्यूनतम तीन वर्षों का वकालती अनुभव होना चाहिए ताकि वह न्यायिक सेवा में आवेदन कर सके। हालांकि, 2002 में सुप्रीम कोर्ट ने इस शर्त को हटा दिया था, जिससे ताजा कानून स्नातकों को मुंशीफ-मजिस्ट्रेट जैसे पदों पर आवेदन करने की अनुमति मिल गई थी। यह कदम इस विश्वास पर आधारित था कि नए उम्मीदवारों को चयन के बाद प्रभावी प्रशिक्षण दिया जा सकता है।

तब से कई याचिकाएं तीन साल की प्रैक्टिस शर्त को फिर से लागू करने की मांग को लेकर दायर की गईं, जिसे कई उच्च न्यायालयों और कानूनी विशेषज्ञों का समर्थन मिला। सुप्रीम कोर्ट ने इस मुद्दे पर 28 जनवरी 2025 को फैसला सुरक्षित रखा था और गुजरात उच्च न्यायालय द्वारा बिना न्यूनतम अनुभव की शर्त के की जा रही भर्ती प्रक्रिया पर रोक भी लगा दी थी।

सुनवाई के दौरान, एमिकस क्यूरी और वरिष्ठ अधिवक्ता सिद्धार्थ भटनागर ने बिना किसी व्यावहारिक अनुभव के नए कानून स्नातकों को न्यायिक सेवा में प्रवेश देने पर चिंता व्यक्त की। उनका तर्क था कि वास्तविक अदालती अनुभव की कमी से न्यायिक गुणवत्ता पर असर पड़ सकता है। पीठ ने इन चिंताओं को स्वीकार किया, लेकिन साथ ही यह भी चर्चा की कि प्रैक्टिस की अनिवार्यता वास्तव में कितनी प्रभावी है, विशेषकर तब जब उम्मीदवार केवल नाम मात्र की वकालत करते हैं।

केवल सिक्किम और छत्तीसगढ़ उच्च न्यायालयों ने यह राय दी कि तीन साल की प्रैक्टिस की आवश्यकता को बहाल करने की कोई जरूरत नहीं है। इसके विपरीत, अधिकांश उच्च न्यायालय और राज्य सरकारें मानती हैं कि ताजा स्नातकों का सीधा प्रवेश न्यायिक सेवा में हानिकारक है और इससे न्यायिक कार्यप्रणाली प्रभावित होती है।

2002 में दिए गए सुप्रीम कोर्ट के फैसले में, ऑल इंडिया जजेस एसोसिएशन मामले में अदालत ने पहले माना था कि तीन साल की प्रैक्टिस की शर्त से योग्य उम्मीदवारों की पहचान में सहायता मिलती है, लेकिन इससे श्रेष्ठ कानूनी प्रतिभाएं हतोत्साहित होती हैं। उस फैसले में कहा गया:

"एक प्रतिभाशाली युवा कानून स्नातक, जो तीन साल की प्रैक्टिस के बाद आता है, को न्यायिक सेवा उतनी आकर्षक नहीं लगती।"

शेट्टी आयोग की सिफारिशों और एमिकस क्यूरी के तर्कों को ध्यान में रखते हुए, 2002 में अदालत ने यह भी कहा कि:

 

*"... तीन साल की प्रैक्टिस की अनिवार्यता आवश्यक नहीं है। राज्य सरकारें और उच्च न्यायालय अपने नियम इस प्रकार संशोधित करें कि ऐसे कानून स्नातक, जिन्होंने तीन साल की प्रैक्टिस भी न की हो, वे न्यायिक सेवा में प्रवेश के लिए पात्र हो सकें। हालांकि, हम यह अनुशंसा करते हैं कि न्यायिक सेवा में नए नियुक्त न्यायाधीशों को *कम से कम एक वर्ष (अथवा दो वर्ष) का प्रशिक्षण दिया जाए।"
