The Supreme Court (SC) today stayed the investigation by the Haryana Police Special Task Force (STF) against Advocate Vikram Singh in connection with a murder case. The Court also confirmed his interim bail.

The bench, comprising Chief Justice of India BR Gavai and Justice K Vinod Chandran, was hearing a writ petition filed by Advocate Vikram Singh, challenging his arrest and remand. The advocate alleged that he was arrested to extract information about his clients. Last week, the Court had ordered his interim release.

Arguments by Senior Counsel Vikas Singh

Sr Advocate Vikas Singh, appearing for the petitioner, urged the Court to refer the matter to the CBI and call for a status report. He also requested that the Court consider discharging the petitioner from the FIR after the CBI report. Singh stressed: "The way the prosecution is behaving in this case is atrocious!"

He added that the police were coercing the petitioner to disclose information about his clients after being called to the police station in the capacity of an advocate.

The Counsel for the State of Haryana refuted this claim, stating that Singh was not called as an advocate. Singh affirmed that, as per the memorandum of the case, he was indeed called as a lawyer.

Allegations of Coercion and Delay in Release

Previously, Sr Advocate Vikas Singh submitted that third-degree torture was inflicted on the lawyer. Singh further explained that the police were pressuring the lawyer to resolve a gangwar dispute, alleging that he represented gangsters. He urged the Court to confirm interim bail and refer the matter to the CBI.

The bench was also informed that despite the Court's bail order on November 12, the petitioner was released only on November 13 at 8:30 PM.

Background of the Case

Vikram Singh was arrested by Gurugram STF on October 31 and remanded to 14 days judicial custody by the Judicial Magistrate, Faridabad, on November 1.

The FIR relates to the murder of Suraj Bhan, allegedly shot dead by the gang of Kapil Sangwan @ Nandu. Singh's client Jyoti Prakash @ Babu was arrested on March 16, 2024.

The petition states that Singh had filed applications alleging ill-treatment of his client in police custody and that the Investigating Officer issued notices under Section 41A of CrPC, demanding he appear and disclose client information, including about Kapil Sangwan.

Singh alleged that when he visited the police station on October 31, he was arrested without justification, describing it as an “exceptional case” warranting Supreme Court intervention.

Impact on Advocate Independence

The petition asserts that the arrest was a calculated attempt to intimidate a member of the Bar for fearless representation of clients. It further alleges that the coercive action defies constitutional safeguards, sending a chilling message to the legal fraternity and undermining the rule of law.

The plea emphasizes the settled legal principle that an advocate cannot be compelled to disclose client-related information or be subjected to coercive action for professional duties. Reference is made to a recent SC judgment directing police officers not to summon advocates for client details.

Additional Allegations of Insensitivity by STF

The petitioner had informed the STF about the Tervi Sanskar, the 13th-day Hindu funeral ritual, on 16.10.2025, following his grandfather’s death. Despite this, STF Gurugram arrested him on 31.10.2025, showing disregard for basic human sensitivity.

The petition also states that after FIR No. 58/2024, then In-charge STF Gurugram, Mr. Narender Chauhan, sought privileged advocate-client communications, issuing threats of further criminal cases, including MACOCA, and warning of humiliation in custody, which were later executed.
