In a landmark move to enhance judicial ties, the Supreme Court of India has today signed a Memorandum of Understanding (MoU) with the Supreme Court of Nepal. The MoU aims to develop, promote, and strengthen judicial cooperation between the two countries, marking a significant step in fostering bilateral legal relations.

Key Signatories

The MoU was signed in the presence of Justice Prakash Man Singh Raut, Chief Justice of Nepal, and Justice Sanjiv Khanna, Chief Justice of India, underscoring the importance of judicial collaboration between the two neighboring nations.

Purpose and Goals of the MoU

The MoU is inspired by the cordial and friendly relations that exist between India and Nepal, focusing on furthering cooperation between their judiciaries. Key objectives of the MoU include:

  • Mutual Exchange of Information: Promoting the exchange of information on the latest developments in law and justice between the two judiciaries.

  • Judicial Interaction: Encouraging interaction among judges and officials through exchange of visits, training programs, and academic initiatives at various levels.

  • Collaboration on Technology: Recognizing the crucial role of technology in improving court procedures, clearing backlogs, and enhancing services, the MoU also emphasizes sharing information on technology used in both countries' courts and institutions.

Joint Working Group to Be Formed

As part of the MoU, a Joint Working Group consisting of officials from both judiciaries will be established. The group will focus on devising plans and modalities for promoting judicial cooperation and further strengthening the relationship between the two countries’ legal systems.

Previous International Judicial Cooperation

The Government of India and the Supreme Court of India have a history of fostering international judicial cooperation. The Indian judiciary has previously signed MoUs with several other countries and organizations, including the Supreme Courts of Israel, Singapore, Bangladesh, Bhutan, Tunisia, Zambia, Morocco, and the Maldives. These agreements aim to promote best practices in law and justice, facilitate judicial exchanges, and enhance cooperation in various aspects of legal systems.

The signing of this MoU with Nepal represents a significant step towards expanding India’s global judicial outreach, with an emphasis on mutual learning, technological advancement, and the strengthening of democratic institutions.
