SC Stays Death Penalty for Madhya Pradesh Convict in 5-Year-Old’s Rape-Murder Case

The Supreme Court has stayed the execution of the death sentence awarded to Atul Nihale, a man convicted of the rape and murder of a 5-year-old girl in Bhopal, Madhya Pradesh. A three-judge bench comprising Justices Vikram Nath, Sandeep Mehta, and NV Anjaria passed the order while hearing the convict’s appeal against the Madhya Pradesh High Court's judgment.
The High Court had earlier confirmed the death sentence, describing the crime as one where "barbarity dripped from every ounce of evidence." The case dates back to September 2024, when the minor victim’s body was discovered in a plastic water tank inside the appellant’s flat after she was reported missing.
While staying the execution, the Apex Court has called for the trial court records and directed the production of several reports to evaluate the convict’s potential for reformation. These include:
- A report from Probation Officers.
- A record of the convict’s conduct and behavior while in jail.
- A comprehensive psychological evaluation of the convict.
The bench emphasized the need to examine mitigating factors before finalizing the punishment, even in cases of such extreme depravity.

नई दिल्ली: सुप्रीम कोर्ट ने मध्य प्रदेश के भोपाल में एक 5 साल की बच्ची के साथ दुष्कर्म और उसकी हत्या के दोषी अतुल निहाले की मौत की सजा पर रोक लगा दी है। जस्टिस विक्रम नाथ, जस्टिस संदीप मेहता और जस्टिस एनवी अंजारिया की तीन न्यायाधीशों की पीठ ने मध्य प्रदेश उच्च न्यायालय के फैसले के खिलाफ दोषी की अपील पर सुनवाई करते हुए यह आदेश पारित किया।
इससे पहले उच्च न्यायालय ने मौत की सजा को बरकरार रखते हुए इस अपराध को अत्यंत क्रूर बताया था और कहा था कि "साक्ष्य के हर कतरे से बर्बरता टपक रही है।" यह मामला सितंबर 2024 का है, जब लापता होने के बाद पीड़िता का शव आरोपी के फ्लैट के अंदर एक प्लास्टिक पानी की टंकी में पाया गया था।
फांसी पर रोक लगाते हुए, शीर्ष अदालत ने निचली अदालत के रिकॉर्ड मांगे हैं और दोषी के सुधार की संभावना का आकलन करने के लिए कई रिपोर्ट पेश करने का निर्देश दिया है। इनमें शामिल हैं:
- परिवीक्षा अधिकारियों (Probation Officers) की रिपोर्ट।
- जेल में रहने के दौरान दोषी के आचरण और व्यवहार का रिकॉर्ड।
- दोषी का व्यापक मनोवैज्ञानिक मूल्यांकन (Psychological Evaluation)।
पीठ ने इस बात पर जोर दिया कि इतनी गंभीर क्रूरता वाले मामलों में भी अंतिम सजा तय करने से पहले कम करने वाले कारकों (mitigating factors) की जांच करना आवश्यक है।
