The Supreme Court of India has held that the authenticity of a First Information Report (FIR) cannot be questioned merely because it was registered based on the statement of a police officer rather than a victim or complainant. The Court made this observation while cancelling the anticipatory bail granted to certain accused in a case involving alleged caste-based abuse under the SC/ST (Prevention of Atrocities) Act, 1989.

Background of the dispute
The case arose from a dispute between two groups in a village where members of a Scheduled Caste community alleged that drainage water from the houses of members belonging to an upper-caste community was being directed into their homes.
When the affected residents protested, tensions escalated and a confrontation reportedly took place between the two groups. Police officials reached the spot to control the situation and mediate between the parties. However, the situation allegedly turned violent during the confrontation.
According to the prosecution, members of the accused group used firearms and hurled caste-based abuses at the complainant side during the clash. The incident was also reportedly captured in a video recording, which became part of the investigation.
Registration of FIR
The police registered an FIR based on the statement of a police officer present at the scene, along with the available material evidence.
The FIR invoked offences under:
- Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989
- Bharatiya Nyaya Sanhita (BNS), 2023

The accused subsequently approached the Punjab and Haryana High Court seeking anticipatory bail.
High Court’s decision
The High Court granted anticipatory bail to the accused. It expressed doubts about the genuineness of the FIR, primarily because the FIR had been registered based on a police officer’s statement rather than a complaint filed by the alleged victims.
The High Court also questioned whether the allegations were sufficient to constitute offences under the SC/ST Act, leading it to grant pre-arrest bail to the accused.
Supreme Court’s observations
The Supreme Court disagreed with the High Court’s reasoning and set aside the order granting anticipatory bail.
The Court emphasised that there is no legal rule requiring that an FIR must be based on the victim’s complaint. It clarified that an FIR recorded on the basis of a police officer’s statement cannot be treated as suspicious or unreliable merely for that reason.
The Bench also noted that the High Court had failed to carefully examine the available records and the seriousness of the allegations before granting anticipatory bail.
The Court observed that the case involved prima facie allegations of caste-based insults and violence, which attract the provisions of the SC/ST (Prevention of Atrocities) Act.
Under Section 18 of the SC/ST Act, anticipatory bail is generally barred when the allegations disclose a prima facie offence under the Act.
Final order
Allowing the appeal, the Supreme Court cancelled the anticipatory bail granted to the accused and directed them to surrender before the authorities within a specified period.
The Court clarified that its observations were prima facie in nature and limited to deciding the bail issue, and that the trial court would independently assess the evidence during the trial.

FIR दर्ज होने की प्रक्रिया
मौके पर मौजूद एक पुलिस अधिकारी के बयान और उपलब्ध साक्ष्यों के आधार पर FIR दर्ज की गई।

हाई कोर्ट का फैसला
हाई कोर्ट ने यह कहते हुए आरोपियों को अग्रिम जमानत दे दी कि FIR पीड़ित की शिकायत के बजाय पुलिस अधिकारी के बयान पर आधारित है, इसलिए इसकी विश्वसनीयता पर संदेह हो सकता है।
हाई कोर्ट ने यह भी सवाल उठाया कि क्या आरोप SC/ST Act के तहत अपराध बनाते हैं या नहीं।
सुप्रीम कोर्ट की टिप्पणी
सुप्रीम कोर्ट ने हाई कोर्ट के इस दृष्टिकोण से असहमति जताई।
अदालत ने कहा कि कानून में ऐसा कोई नियम नहीं है कि FIR केवल पीड़ित की शिकायत पर ही दर्ज हो सकती है।
अदालत ने स्पष्ट किया कि यदि FIR पुलिस अधिकारी के बयान के आधार पर दर्ज की गई है तो केवल इस कारण उसे संदिग्ध नहीं माना जा सकता।
सुप्रीम कोर्ट ने यह भी कहा कि हाई कोर्ट ने मामले की गंभीरता और रिकॉर्ड में मौजूद सामग्री का उचित परीक्षण किए बिना अग्रिम जमानत दे दी।
अदालत ने याद दिलाया कि SC/ST Act की धारा 18 के तहत ऐसे मामलों में अग्रिम जमानत पर सामान्यतः रोक होती है, यदि प्रथम दृष्टया अपराध बनता है।
अंतिम आदेश
सुप्रीम कोर्ट ने अपील स्वीकार करते हुए आरोपियों को दी गई अग्रिम जमानत रद्द कर दी और उन्हें निर्धारित समय के भीतर संबंधित प्राधिकारियों के समक्ष आत्मसमर्पण करने का निर्देश दिया।
अदालत ने यह भी स्पष्ट किया कि उसके ये अवलोकन केवल जमानत के प्रश्न तक सीमित हैं और ट्रायल अदालत स्वतंत्र रूप से मामले की सुनवाई करेगी।
