Punjab & Haryana High Court: Litigants cannot backtrack and blame lawyers after withdrawing cases

The Punjab and Haryana High Court has held that litigants cannot backtrack on their decision to withdraw a case and subsequently blame their lawyer by claiming lack of instructions, emphasizing that such conduct undermines the integrity of the judicial process.

The ruling was delivered by Justice Sumeet Goel, who strongly criticised attempts by litigants to disown statements made by their counsel in court.

The Court observed that backtracking under the pretext of “lack of instructions” amounts to “procedural heresy”, striking at the very foundation of the advocate-client relationship and the administration of justice.

The case arose when the petitioner sought recall of an earlier order whereby his anticipatory bail plea had been dismissed as withdrawn, claiming that his lawyer had acted without proper instructions. However, the Court found no merit in this argument and rejected the plea.

The High Court emphasized that once a litigant signs a vakalatnama, the counsel is duly authorised to act and make statements on behalf of the client in court, and such statements are binding on the litigant.

It further observed that allowing litigants to later deny their lawyer’s actions would lead to uncertainty in judicial proceedings and encourage misuse of legal processes.

The Court noted that the judicial system operates on the presumption that statements made by counsel reflect the true intent of the client, and questioning this presumption would severely disrupt court proceedings.

Rejecting the petitioner’s plea, the Court held that such attempts appear to be aimed at evading the consequences of earlier judicial orders and warned against turning courts into a platform for “experimental litigation.”

The Court ultimately dismissed the application and reiterated that litigants must bear responsibility for decisions taken through their authorised legal representatives.

This judgment reinforces the principle that the sanctity of court proceedings and the advocate-client relationship must be preserved, and litigants cannot be permitted to conveniently shift blame after making procedural choices.

Punjab and Haryana High Court ने एक महत्वपूर्ण निर्णय में कहा है कि कोई भी मुक़दमेबाज़ मामला वापस लेने के बाद अपनी बात से पलटकर यह नहीं कह सकता कि उसके वकील ने बिना निर्देश के ऐसा किया।

यह फैसला Justice Sumeet Goel ने दिया, जिसमें उन्होंने कहा कि इस प्रकार का तर्क न्यायिक प्रक्रिया के मूल सिद्धांतों को कमजोर करता है।

अदालत ने कहा कि “निर्देशों की कमी” का बहाना बनाकर पीछे हटना एक प्रकार की “प्रक्रियात्मक त्रुटि (procedural heresy)” है, जो वकील-मुवक्किल संबंध और न्याय व्यवस्था दोनों पर आघात करता है।

मामले में याचिकाकर्ता ने पहले अपनी अग्रिम जमानत याचिका वापस ले ली थी, लेकिन बाद में उसने आदेश को वापस लेने की मांग करते हुए कहा कि उसके वकील ने बिना निर्देश के यह कदम उठाया था।

अदालत ने इस तर्क को खारिज करते हुए कहा कि वकालतनामा पर हस्ताक्षर करने के बाद वकील को अदालत में मुवक्किल की ओर से कार्य करने का अधिकार होता है, और उसके द्वारा दिए गए बयान मुवक्किल पर बाध्यकारी होते हैं।

हाईकोर्ट ने यह भी कहा कि यदि ऐसे तर्कों को स्वीकार किया जाए तो न्यायिक प्रक्रिया में अनिश्चितता और दुरुपयोग की संभावना बढ़ जाएगी।

अदालत ने स्पष्ट किया कि न्यायालय इस आधार पर कार्य करता है कि वकील द्वारा दिए गए बयान मुवक्किल की वास्तविक मंशा को दर्शाते हैं, और इस सिद्धांत को कमजोर नहीं किया जा सकता।

अंततः अदालत ने याचिका खारिज कर दी और कहा कि मुक़दमेबाज़ को अपने वकील के माध्यम से लिए गए निर्णयों की जिम्मेदारी उठानी होगी।

यह निर्णय न्यायिक प्रक्रिया की पवित्रता और वकील-मुवक्किल संबंध की मजबूती को बनाए रखने के लिए महत्वपूर्ण माना जा रहा है।
