In a significant development related to the ongoing farmer’s protests, the Punjab & Haryana High Court has issued a notice to the Punjab Government in response to a habeas corpus petition filed by Gurmukh Singh for the release of Jagjit Singh Dallewal, a prominent farmer leader.

Allegations of Illegal Detention

The petition, received at 6:45 pm on March 19, 2025, alleges that Dallewal, a leader of the Joint Forum Sanyukt Kisan Morcha (non-political), has been illegally detained by the Punjab Police. According to the plea, Dallewal, who had been on a hunger strike for over 100 days, participated in the seventh round of talks with a central delegation headed by the Union Agriculture Minister. Following the talks, Dallewal’s convoy was intercepted by Punjab Police near Jagatpura, Mohali while returning to the protest site at Shambhu and Khanauru borders.

The petition further claims that Dallewal, along with other farmer leaders, was detained without prior notice or explanation, leading to clashes between farmers and police. Additionally, the plea states that between 300 to 400 other farmer organization members are missing.

Court's Directions and Pending Hearing

Justice Manisha Batra, in response to the petition, directed the Punjab Government and the Director General of Police to file a reply, while also indicating that the case would be considered further on March 24, 2025. The Court’s issuance of notice brings attention to the alleged unlawful detention and raises questions about the legality of the actions taken by the police against peaceful protesters.

The habeas corpus petition was filed by Advocates Gurmohan Preet Singh, Angrej Singh, and Kanwarjit Singh on behalf of Gurmukh Singh, who seeks the immediate release of Jagjit Singh Dallewal. The case underscores ongoing tensions around the farmer’s protest, with growing concerns regarding freedom of expression and right to protest, as well as potential human rights violations arising from the actions of state authorities.
