Punjab & Haryana High Court Declares Arrest of Music Producer Illegal Due to Non-Compliance with Procedural Safeguards

The case concerns Pushpinder Pal Singh Dhaliwal, a music producer, who was arrested following accusations of harassment, cheating, and wrongful restraint made by Punjabi singer Sunanda Sharma on social media. The arrest took place on the evening of March 8, 2025, without the provision of an arrest memo or the grounds for arrest being communicated to the detainee.

A habeas corpus plea was filed by Dhaliwal’s daughter, who argued that her father’s arrest was illegal due to non-compliance with mandatory procedural requirements. The petition emphasized that he was not informed of the grounds for his arrest for several hours, thus violating the constitutional protection against unlawful detention.

Court's Analysis and Ruling

In its judgment, the bench, led by Justice Harpreet Singh Brar, noted that the grounds for arrest were communicated to Dhaliwal seven hours after his detention. This delay in informing the detained individual of the reasons for his arrest was found to be in direct violation of Article 22 of the Constitution and the provisions of Section 47 of BNSS, 2023.

The court remarked, "Such procedural lapses are in direct contravention of Article 21 of the Constitution of India, thereby rendering his custody illegal in the eyes of law." The delay, coupled with the non-issuance of an arrest memo at the time of detention, was deemed an infringement on the detainee's fundamental rights.

Violation of Constitutional Safeguards

Justice Brar underscored the importance of safeguarding personal liberty, observing that the failure to inform the detainee about the grounds for his arrest within a reasonable timeframe undermines the core tenet of the rule of law. He referred to the landmark case of D.K. Basu v. State of West Bengal, which established clear procedural safeguards to prevent police abuse and ensure transparency during detention and arrest.

The court noted that the Warrant Officer assigned to inspect the case arrived at the police station at 12:40 AM on March 9, by which time no arrest memo had been issued. The officer’s comments regarding the legality of the arrest were also ruled as beyond jurisdiction, as the role of the Warrant Officer is considered ministerial in nature, not adjudicatory.

Justice Brar further pointed out that Article 22(1) of the Constitution mandates that every arrested individual must be informed of the reasons for their detention “as soon as may be”. Similarly, Section 47 of BNSS requires the grounds of arrest to be communicated forthwith, reinforcing the necessity for timely and transparent communication.

The court also referred to the Supreme Court decision in Vihaan Kumar v. State of Haryana to support the argument that the grounds for arrest must be provided in writing to the arrested individual. The failure to inform Dhaliwal of the grounds of his arrest was therefore deemed to be a violation of both Article 22 and Article 21, resulting in an illegal arrest. As a result of these procedural violations, the court declared Dhaliwal’s arrest to be illegal and ordered his immediate release. The ruling emphasized that any action stemming from an unlawful arrest, such as obtaining a remand order from a jurisdictional magistrate, would be rendered void ab initio.
