The Kerala Advocates’ Welfare Fund (Amendment) Act, 2026 has officially come into force after the Government of Kerala issued a notification on March 9, 2026, bringing the amended law into immediate effect. The amendment introduces important changes to the Kerala Advocates’ Welfare Fund Act, 1980, which governs the welfare fund meant for providing retirement and related benefits to advocates in the state.

Purpose of the Welfare Fund

The Kerala Advocates’ Welfare Fund Act, 1980 was enacted to create a dedicated welfare fund for advocates practicing in Kerala. The fund primarily provides retirement benefits and financial assistance to advocates and addresses matters related to their welfare.

Over the years, amendments have been introduced to improve the administration and functioning of the welfare fund. The latest amendment in 2026 aims to further streamline the structure and functioning of the Kerala Advocates’ Welfare Fund Trustee Committee, which administers the fund.

Changes in the Trustee Committee Composition

One of the key changes introduced by the amendment concerns the composition of the Kerala Advocates’ Welfare Fund Trustee Committee.

Under the amended law:

  • The number of government-nominated members in the Trustee Committee has been increased from one to two.
  • The Secretary of the Trustee Committee will now be appointed by the Government, instead of being appointed by the Secretary of the Bar Council.

Despite these changes, the remaining structure of the committee remains largely unchanged. The committee will continue to include:

  • The Advocate General of Kerala
  • The Law Secretary to the Government
  • Three members from the Bar Council
  • The Treasurer of the Bar Council
  • The President of the Kerala Bar Federation

Administrative and Regulatory Provisions

The amendment also enables the Bar Council of Kerala to prescribe procedural rules related to certain administrative aspects of the welfare fund.

These include:

  • Prescribing the format of applications for counting the previous period of actual legal practice for existing members.
  • Determining the service conditions and pay scale of staff working under the Welfare Fund Trustee Committee.

These provisions are intended to improve the administrative efficiency of the welfare fund and ensure better governance of the institution.

Significance of the Amendment

The amendment is expected to strengthen the governance framework of the welfare fund and enhance the role of the state government in its administration.

By modifying the composition of the Trustee Committee and clarifying procedural powers, the amendment seeks to ensure better management of funds and more efficient delivery of welfare benefits to advocates in Kerala.


केरल एडवोकेट्स वेलफेयर फंड (संशोधन) अधिनियम, 2026 लागू

Kerala Advocates’ Welfare Fund (Amendment) Act, 2026 को आधिकारिक रूप से लागू कर दिया गया है। Government of Kerala ने 9 मार्च 2026 को इसकी अधिसूचना जारी की, जिसके बाद यह संशोधित कानून तुरंत प्रभाव से लागू हो गया। यह संशोधन Kerala Advocates’ Welfare Fund Act, 1980 में बदलाव करता है, जो राज्य में अधिवक्ताओं को सेवानिवृत्ति और अन्य कल्याणकारी लाभ प्रदान करने के लिए बनाया गया था।

वेलफेयर फंड का उद्देश्य

Kerala Advocates’ Welfare Fund Act, 1980 का उद्देश्य केरल में प्रैक्टिस करने वाले अधिवक्ताओं के लिए एक विशेष वेलफेयर फंड स्थापित करना था। यह फंड मुख्य रूप से अधिवक्ताओं को सेवानिवृत्ति लाभ और वित्तीय सहायता प्रदान करने के लिए बनाया गया है।

ट्रस्टी समिति की संरचना में बदलाव

संशोधन अधिनियम के तहत Kerala Advocates’ Welfare Fund Trustee Committee की संरचना में महत्वपूर्ण बदलाव किया गया है।

संशोधित प्रावधानों के अनुसार:

  • ट्रस्टी समिति में सरकार द्वारा नामित सदस्यों की संख्या एक से बढ़ाकर दो कर दी गई है।
  • समिति के सचिव की नियुक्ति अब सरकार द्वारा की जाएगी, जबकि पहले यह नियुक्ति बार काउंसिल के सचिव द्वारा की जाती थी।

हालांकि समिति की अन्य संरचना पहले की तरह ही बनी रहेगी। इसमें शामिल होंगे:

  • केरल के एडवोकेट जनरल
  • राज्य सरकार के विधि सचिव
  • बार काउंसिल के तीन सदस्य
  • बार काउंसिल के कोषाध्यक्ष
  • केरल बार फेडरेशन के अध्यक्ष

प्रशासनिक और नियामक प्रावधान

संशोधन अधिनियम के तहत Bar Council of Kerala को कुछ प्रशासनिक नियम निर्धारित करने की शक्ति भी दी गई है।

इनमें शामिल हैं:

  • मौजूदा सदस्यों के लिए पूर्व कानूनी प्रैक्टिस की अवधि को गिनने हेतु आवेदन के प्रारूप को निर्धारित करना।
  • वेलफेयर फंड ट्रस्टी समिति के कर्मचारियों के वेतनमान और सेवा शर्तों को निर्धारित करना।

संशोधन का महत्व

यह संशोधन वेलफेयर फंड के प्रशासन को अधिक प्रभावी बनाने की दिशा में एक महत्वपूर्ण कदम माना जा रहा है।

ट्रस्टी समिति की संरचना में बदलाव और प्रशासनिक प्रक्रियाओं को स्पष्ट करने से फंड के बेहतर प्रबंधन और अधिवक्ताओं को मिलने वाले कल्याणकारी लाभों के प्रभावी वितरण में मदद मिलने की उम्मीद है।
