In a notable development involving judicial propriety and political speech, a petition has been filed before the Advocate General of Kerala seeking consent to initiate criminal contempt proceedings against Leader of Opposition V.D. Satheesan over alleged remarks about former Kerala High Court Chief Justice A.J. Desai.

The plea has been moved by Ramees P.K., an advocate practising in the Kerala High Court, who contends that Satheesan’s public statements were derogatory and contemptuous in nature and had the effect of scandalising the authority of the judiciary.

According to the petition, the controversy arose after Satheesan addressed the media regarding an earlier oral observation made by the former Chief Justice while hearing a public interest litigation (PIL) related to the Kerala Fibre Optic Network (K-FON) project. The Chief Justice had reportedly questioned whether the litigation was in public interest or for publicity, following which Satheesan made remarks criticised in the contempt plea.

The petitioner argues that the comments allegedly demean the office of the Chief Justice, portray judicial functioning as arbitrary, and potentially erode public confidence in the justice delivery system. The plea invokes provisions of the Contempt of Courts Act, 1971, particularly the definition of criminal contempt involving acts that lower the authority of courts.

If consent is granted by the Advocate General, formal criminal contempt proceedings may follow. Legal observers note that such cases often involve balancing freedom of political speech with the need to maintain respect for judicial institutions.


केरल में आपराधिक अवमानना की मांग — विपक्ष के नेता वी.डी. सतीशन के खिलाफ AG से अनुमति की याचिका

न्यायपालिका की गरिमा और राजनीतिक बयानबाज़ी से जुड़े एक महत्वपूर्ण घटनाक्रम में केरल के एडवोकेट जनरल के समक्ष याचिका दायर कर विपक्ष के नेता वी.डी. सतीशन के खिलाफ आपराधिक अवमानना कार्यवाही शुरू करने की अनुमति मांगी गई है। आरोप है कि उन्होंने पूर्व केरल हाई कोर्ट मुख्य न्यायाधीश ए.जे. देसाई के बारे में कथित तौर पर अपमानजनक टिप्पणी की।

यह याचिका केरल हाई कोर्ट में प्रैक्टिस करने वाले अधिवक्ता रमेश पी.के. द्वारा दायर की गई है। याचिकाकर्ता का दावा है कि सतीशन के बयान न्यायपालिका की प्रतिष्ठा को कम करने वाले तथा अवमाननापूर्ण प्रकृति के हैं।

विवाद उस समय उत्पन्न हुआ जब सतीशन ने मीडिया से बातचीत में उस मौखिक टिप्पणी पर प्रतिक्रिया दी जो पूर्व मुख्य न्यायाधीश ने केरल फाइबर ऑप्टिक नेटवर्क (K-FON) परियोजना से जुड़ी जनहित याचिका की सुनवाई के दौरान की थी।

याचिका में कहा गया है कि उक्त बयान मुख्य न्यायाधीश के पद की गरिमा को ठेस पहुंचाते हैं और न्यायिक प्रक्रिया पर जनविश्वास को प्रभावित कर सकते हैं। इसमें Contempt of Courts Act, 1971 के प्रावधानों का हवाला दिया गया है।

 

यदि एडवोकेट जनरल अनुमति देते हैं तो इस मामले में औपचारिक आपराधिक अवमानना कार्यवाही शुरू हो सकती है। कानूनी विशेषज्ञों के अनुसार यह मामला अभिव्यक्ति की स्वतंत्रता और न्यायपालिका के सम्मान के बीच संतुलन जैसे महत्वपूर्ण प्रश्न उठाता है।
