Former Chief Justice of the Calcutta High Court, Justice T.S. Sivagnanam, has resigned from the Appellate Tribunal constituted to hear appeals arising out of the Special Intensive Revision (SIR) of electoral rolls in West Bengal.

The resignation comes shortly after the conclusion of the West Bengal Assembly Elections 2026 and has triggered discussions in legal and political circles due to the sensitive nature of the SIR process and the large number of voters affected.


Justice Sivagnanam Cited ‘Personal Reasons’

According to reports, Justice Sivagnanam submitted his resignation to the present Chief Justice of the Calcutta High Court, Justice Sujoy Paul. The Election Commission of India (ECI) and the Chief Electoral Officer of West Bengal were also informed about the development.

When contacted by media organisations, Justice Sivagnanam reportedly stated that he resigned due to “personal reasons.”

However, the resignation has attracted public attention because of the tribunal’s crucial role in adjudicating disputes concerning inclusion and exclusion of names from electoral rolls during the SIR exercise.


Background: What Was The SIR Exercise?

The Special Intensive Revision (SIR) of electoral rolls in West Bengal was conducted ahead of the 2026 Assembly Elections to verify voter records and remove allegedly doubtful or duplicate entries.

The exercise led to the exclusion of a very large number of names from the voter lists, following scrutiny conducted by designated judicial officers.

Subsequently, lakhs of affected voters challenged their deletion through appeals.

Reports suggest that:

  • More than 27 lakh appeals were filed by affected persons against exclusion from electoral rolls.
  • Over 90 lakh names had reportedly been excluded during the revision process.

The scale of the exercise made it one of the most controversial electoral verification exercises in recent years.


Supreme Court’s Intervention

The Supreme Court had earlier intervened in the matter and directed the deployment of judicial officers to adjudicate claims relating to deletion of names from voter lists.

The apex court also ordered the constitution of Appellate Tribunals headed by retired judges to hear appeals against decisions of judicial officers.

Following these directions, the Election Commission constituted 19 Appellate Tribunals in March 2026.

Among them:

  • 18 tribunals were headed by retired High Court judges.
  • One tribunal was headed by a former Chief Justice of the Calcutta High Court.

Justice T.S. Sivagnanam was one of the retired judges appointed to hear these appeals.


Role Played By Justice Sivagnanam

Justice Sivagnanam was handling several important appeals arising from the SIR process.

His tribunal reportedly heard high-profile matters involving:

  • Suprabuddha Sen, grandson of legendary artist Nandalal Bose.
  • Congress leader Motab Shaikh, whose name had been deleted from the electoral roll before, later being restored.

In one notable order, Justice Sivagnanam’s tribunal restored Motab Shaikh’s voter status after overturning the earlier deletion order.

The Supreme Court had also directed out-of-turn hearings in certain urgent matters, some of which were assigned to Justice Sivagnanam’s tribunal.


Questions Raised Over Effectiveness Of Tribunal Mechanism

The SIR appellate process had itself come under criticism from multiple quarters.

Several reports indicated:

  • Confusion among appellants regarding hearing procedures.
  • Delays in disposal of appeals.
  • Extremely low success rates for restoration of names.

According to reports, only a very small number of appellants ultimately secured relief through the tribunal mechanism despite lakhs of appeals being filed.

This had led to criticism from opposition parties and civil society groups, who alleged that the process disproportionately affected genuine voters.


Who Is Justice T.S. Sivagnanam?

Justice T.S. Sivagnanam served as the Chief Justice of the Calcutta High Court before retiring in 2025.

He was known for handling significant constitutional, administrative, and election-related matters during his tenure on the Bench.

Following his retirement, he was appointed by the Election Commission as one of the appellate tribunal judges pursuant to Supreme Court directions.


Political And Legal Significance

The resignation has assumed significance because:

  • The SIR process was politically contentious.
  • Large-scale voter exclusions had become a major election issue in West Bengal.
  • The appellate tribunals were functioning under Supreme Court-monitored directions.

Legal observers believe the resignation may raise fresh questions regarding:

  • functioning of the appellate mechanism,
  • transparency of the voter revision process,
  • and adequacy of safeguards available to excluded voters.

No Official Response Yet From ECI

As of now, the Election Commission has not issued any detailed public statement regarding:

  • acceptance of the resignation,
  • appointment of a replacement,
  • or the impact on pending appeals before the tribunal.

Further developments in the matter are awaited.

कलकत्ता हाई कोर्ट के पूर्व मुख्य न्यायाधीश Justice T.S. Sivagnanam ने पश्चिम बंगाल में मतदाता सूची के Special Intensive Revision (SIR) से जुड़े मामलों की सुनवाई के लिए गठित Appellate Tribunal से इस्तीफा दे दिया है।

यह इस्तीफा पश्चिम बंगाल विधानसभा चुनाव 2026 के समाप्त होने के कुछ ही समय बाद आया है और इससे कानूनी तथा राजनीतिक हलकों में व्यापक चर्चा शुरू हो गई है।


‘व्यक्तिगत कारणों’ का हवाला

रिपोर्ट्स के अनुसार Justice Sivagnanam ने अपना इस्तीफा वर्तमान Calcutta High Court Chief Justice Justice Sujoy Paul को भेजा। इसके साथ ही Election Commission of India (ECI) तथा West Bengal के Chief Electoral Officer को भी इसकी जानकारी दी गई।

मीडिया से बातचीत में उन्होंने कहा कि उन्होंने “व्यक्तिगत कारणों” से इस्तीफा दिया है।

हालांकि, उनके इस्तीफे ने इसलिए विशेष महत्व प्राप्त किया है क्योंकि यह ट्रिब्यूनल मतदाता सूची से नाम हटाए जाने से संबंधित अपीलों की सुनवाई कर रहा था।


क्या था SIR Exercise?

West Bengal Assembly Elections 2026 से पहले राज्य में मतदाता सूची की Special Intensive Revision (SIR) प्रक्रिया चलाई गई थी। इसका उद्देश्य कथित रूप से संदिग्ध या डुप्लीकेट नामों की पहचान करना था।

इस प्रक्रिया के दौरान बड़ी संख्या में मतदाताओं के नाम मतदाता सूची से हटाए गए।

इसके बाद लाखों लोगों ने अपने नाम हटाए जाने के खिलाफ अपील दायर की।

रिपोर्ट्स के अनुसार:

  • लगभग 27 लाख अपीलें दायर की गईं।
  • 90 लाख से अधिक नाम मतदाता सूची से हटाए गए थे।

यह प्रक्रिया हाल के वर्षों की सबसे विवादास्पद चुनावी सत्यापन प्रक्रियाओं में से एक मानी गई।


सुप्रीम कोर्ट का हस्तक्षेप

सुप्रीम Court ने इस मामले में हस्तक्षेप करते हुए न्यायिक अधिकारियों की नियुक्ति का निर्देश दिया था ताकि वे मतदाता सूची से नाम हटाए जाने संबंधी विवादों का निपटारा कर सकें।

इसके अतिरिक्त, Supreme Court ने अपीलों की सुनवाई के लिए सेवानिवृत्त न्यायाधीशों की अध्यक्षता में Appellate Tribunals गठित करने का भी निर्देश दिया।

इसके बाद मार्च 2026 में Election Commission ने 19 Appellate Tribunals गठित किए।

इनमें:

  • 18 ट्रिब्यूनल सेवानिवृत्त हाई कोर्ट न्यायाधीशों की अध्यक्षता में थे।
  • एक ट्रिब्यूनल पूर्व Chief Justice द्वारा संचालित था।

Justice T.S. Sivagnanam भी इन्हीं न्यायाधीशों में शामिल थे।


Justice Sivagnanam की भूमिका

Justice Sivagnanam कई महत्वपूर्ण मामलों की सुनवाई कर रहे थे।

उनके समक्ष जिन प्रमुख मामलों की सुनवाई हुई उनमें शामिल थे:

  • प्रसिद्ध कलाकार नंदलाल बोस के पौत्र Suprabuddha Sen का मामला।
  • Congress नेता Motab Shaikh का मामला, जिनका नाम बाद में पुनः मतदाता सूची में बहाल किया गया।

रिपोर्ट्स में कहा गया:

  • अपील प्रक्रिया को लेकर भ्रम की स्थिति थी।
  • सुनवाई में देरी हो रही थी।
  • बहुत कम लोगों को राहत मिल पा रही थी।

बताया गया कि लाखों अपीलों में से केवल बहुत कम लोगों के नाम पुनः बहाल किए जा सके।


Justice T.S. Sivagnanam कौन हैं?

Justice T.S. Sivagnanam Calcutta High Court के Chief Justice रह चुके हैं और 2025 में सेवानिवृत्त हुए थे।

वे संवैधानिक, प्रशासनिक तथा चुनावी मामलों की सुनवाई के लिए जाने जाते थे।

सेवानिवृत्ति के बाद Election Commission ने उन्हें Supreme Court के निर्देशों के तहत Appellate Tribunal Judge नियुक्त किया था।


मामले का महत्व

यह इस्तीफा कई कारणों से महत्वपूर्ण माना जा रहा है:

  • SIR प्रक्रिया राजनीतिक रूप से अत्यंत विवादास्पद थी।
  • बड़े पैमाने पर मतदाता सूची से नाम हटाए गए थे।
  • पूरी प्रक्रिया Supreme Court की निगरानी में चल रही थी।

कानूनी विशेषज्ञों का मानना है कि यह इस्तीफा:

  • अपीलीय तंत्र की कार्यप्रणाली,
  • मतदाता सूची संशोधन प्रक्रिया की पारदर्शिता,
  • और मतदाताओं को उपलब्ध सुरक्षा उपायों

पर नए प्रश्न खड़े कर सकता है।


ECI की ओर से अभी कोई विस्तृत प्रतिक्रिया नहीं

अब तक Election Commission की ओर से:

  • इस्तीफा स्वीकार किए जाने,
  • नए सदस्य की नियुक्ति,
  • या लंबित मामलों पर प्रभाव

को लेकर कोई विस्तृत आधिकारिक बयान जारी नहीं किया गया है।
