Delhi Court Issues Ex Parte Ad-Interim Injunction Against Viral Video Accusing ‘Guru-ji’ and Followers of Fraud and Rape

A Delhi District Court has granted an ex parte ad-interim injunction directing the removal of a viral video from online platforms that allegedly accused a spiritual leader referred to as “Guru-ji” and his followers of fraud and rape, holding that the content prima facie amounted to defamatory allegations.

The injunction was passed by the Delhi District Judge’s Court on an application filed by the spiritual leader, identified in court records as Guru Giri (name anonymised in reporting), through his counsel. The plaintiff sought urgent relief to restrain the dissemination and viewing of a video that had gone viral on social media platforms and various video-sharing websites.

According to court documents, the video contained serious allegations that the petitioner and certain followers were involved in fraudulent activities and sexual assault. The plaintiff contended that the accusations were false, unverified and defamatory, causing irreparable harm to his reputation and social standing.

The petition argued that the video had millions of views and was widely shared across multiple platforms, significantly amplifying the alleged defamatory impact. The plaintiff’s counsel asserted that the dissemination of such content — without verification of its authenticity — had already caused “**irreparable damage” to the petitioner’s name and goodwill.

Noting the urgency of the situation, the Court considered that if the video were allowed to remain online, the reputation of the petitioner and his followers would continue to suffer. The Court observed that ex parte interim relief was justified given the potential for continuing harm and the difficulty in tracing and removing such content once it spreads widely.

The order directed the defendants/online intermediaries to take down the impugned video from all platforms — including social media channels and video-hosting sites — within the shortest possible time. The Court also restrained further sharing, liking, uploading or distribution of the video until further orders.

Legal experts say that this order underscores the judiciary’s willingness to grant interim remedies in digital defamation cases where reputation and dignity are at stake, especially given the viral reach of online content. They note that injunctions in such matters seek to balance freedom of speech with protection against unverified defamatory allegations.

The matter is likely to return to the Court for further hearings on pleadings and evidence, at which stage the defendants will have an opportunity to contest the allegations and the continued restraint.

नई दिल्ली: दिल्ली जिला अदालत ने एक एक-पक्षीय अंतरिम निषेधाज्ञा (ex parte ad-interim injunction) जारी करते हुए एक वायरल वीडियो को ऑनलाइन प्लेटफॉर्मों से हटाने का निर्देश दिया है, जिसमें एक आध्यात्मिक नेता — जिसे “गुरु-जी” के नाम से संदर्भित किया गया है — और उनके अनुयायियों पर धोखाधड़ी और बलात्कार के गंभीर आरोप लगाए गए थे।

अदालत ने यह आदेश उस याचिका पर जारी किया, जिसे आध्यात्मिक नेता गुरु गिरि (नाम रिपोर्टिंग में गुमनाम किया गया है) द्वारा अपने वकील के माध्यम से दाखिल किया गया था। याचिकाकर्ता ने दावा किया कि आरोप झूठे, अविश्वसनीय और मानहानिकारक थे तथा उनके प्रतिष्ठा और सम्मान को गंभीर नुकसान पहुँचा रहे थे।

याचिका में बताया गया कि यह वीडियो लाखों बार देखा और साझा किया गया, जिससे मानहानि का प्रभाव बढ़ा है। वादी पक्ष के वकील ने तर्क दिया कि ऐसी सामग्री की सत्यता का कोई प्रमाण नहीं है, पर यह पहले ही व्यापक रूप से प्रसारित हो चुकी है, जिससे “अपरिवर्तनीय नुकसान” हुआ है।

कोर्ट ने देखा कि यदि वीडियो को ऑनलाइन रहने दिया गया तो याचिकाकर्ता और उनके अनुयायी लगातार प्रतिष्ठा हानि का सामना करेंगे। ऐसे संभावित निरंतर नुकसान को देखते हुए, अदालत ने एक-पक्षीय अंतरिम राहत न्यायोचित समझी।

आदेश में प्रतिवादी / ऑनलाइन इंटरमीडियरीज को निर्देश दिया गया कि वे साथ ही सभी प्लेटफॉर्मों से विवादित वीडियो को हटाएँ, जिसमें सोशल मीडिया और वीडियो होस्टिंग साइटें शामिल हैं। अदालत ने वीडियो को शेयर, लाइक, अपलोड या वितरित करने पर भी रोक लगा दी है।

कानूनी विशेषज्ञों का कहना है कि यह आदेश डिजिटल मानहानि मामलों में प्रतिष्ठा और गरिमा की रक्षा के लिए अंतरिम राहत प्रदान करने में न्यायपालिका की तत्परता को दर्शाता है। साथ ही न्यायालय ने अभिव्यक्ति की स्वतंत्रता और अवैध/अमान्य मानहानिकारक आरोपों के बीच संतुलन स्थापित करने का प्रयास किया है।

 

मामला आगे आगे अगली सुनवाई के लिए लौट सकता है, जिसमें प्रतिवादी पक्ष आरोपों और जारी रोक के खिलाफ अपनी दलीलें प्रस्तुत कर सकेगा।
