Allahabad High Court Raps Chief Judicial Magistrate for Justifying Illegal Order as “Usual Practice in UP”
The Allahabad High Court has strongly criticised a Chief Judicial Magistrate (CJM) for attempting to justify an illegal judicial order by citing it as a “usual practice” followed in magisterial courts in Uttar Pradesh, calling the explanation unacceptable and contrary to law.
The Court made the observation while quashing criminal proceedings in a theft case where cognisance had been taken beyond the statutory limitation period prescribed under the Code of Criminal Procedure (CrPC).
The Bench, while examining the matter, noted that the CJM had taken cognisance of the offence despite the expiry of the legally permissible period. When asked to explain the delay, the CJM submitted that it was a common practice in magisterial courts not to conduct detailed scrutiny of police reports before taking cognisance.
Rejecting this justification, the High Court observed that judicial practice cannot override statutory law, and that such an approach reflects a casual attitude towards judicial duties. The Court remarked that a so-called “practice” cannot substitute compliance with legal provisions laid down in the CrPC.
Case Background
The case related to a motorcycle theft incident registered in July 2019 under Section 379 of the Indian Penal Code. While the first chargesheet against some accused was filed within time and cognisance was taken promptly, the second chargesheet against other accused was filed much later.
The High Court found that the second chargesheet was submitted after an inordinate delay, and cognisance was taken beyond the three-year limitation period prescribed under Section 468 of the CrPC. Consequently, the Court quashed the proceedings against the accused.

The High Court expressed serious concern over the manner in which judicial officers were dealing with statutory requirements. It emphasised that taking cognisance is the foundation of a criminal case, and therefore must strictly comply with legal timelines.

In a significant step, the High Court directed the Judicial Training and Research Institute (JTRI), Lucknow to impart training to judicial officers on the importance of following legal provisions while taking cognisance of offences.
The Court stressed that judicial officers must understand that legality, not convenience or customary practice, must guide judicial decision-making.

यह मामला जुलाई 2019 में दर्ज एक मोटरसाइकिल चोरी से संबंधित था। पहले आरोपियों के खिलाफ समय पर आरोपपत्र दाखिल किया गया और संज्ञान लिया गया, लेकिन अन्य आरोपियों के खिलाफ दूसरा आरोपपत्र काफी देर से दाखिल किया गया।
हाई कोर्ट ने पाया कि दूसरा आरोपपत्र अत्यधिक देरी से दाखिल हुआ और CrPC की धारा 468 के तहत निर्धारित तीन वर्ष की सीमा के बाद संज्ञान लिया गया। इसलिए कोर्ट ने आरोपी के खिलाफ आपराधिक कार्यवाही को रद्द कर दिया।

हाई कोर्ट ने निचली अदालतों की कार्यप्रणाली पर गंभीर चिंता व्यक्त की। कोर्ट ने कहा कि संज्ञान लेना आपराधिक मामले की आधारशिला है, इसलिए इसे कानून के अनुसार ही किया जाना चाहिए।
कोर्ट ने यह भी कहा कि न्यायिक सेवा को हल्के में लेना कानून के शासन को कमजोर करता है और न्याय व्यवस्था में जनता के विश्वास को प्रभावित करता है।
हाई कोर्ट के निर्देश
हाई कोर्ट ने न्यायिक प्रशिक्षण एवं अनुसंधान संस्थान (JTRI), लखनऊ को निर्देश दिया कि वह न्यायिक अधिकारियों को संज्ञान लेने से संबंधित कानूनी प्रावधानों पर प्रशिक्षण प्रदान करे।
कोर्ट ने जोर देकर कहा कि न्यायिक निर्णय सुविधा या प्रचलित प्रथाओं के बजाय कानून पर आधारित होने चाहिए।

कानूनी विशेषज्ञों का मानना है कि यह फैसला उत्तर प्रदेश की निचली अदालतों के लिए एक कड़ा संदेश है कि कानून से विचलन को किसी भी “प्रथा” के नाम पर सही नहीं ठहराया जा सकता।
