In a significant ruling, the Allahabad High Court has dismissed a petition seeking the quashing of criminal proceedings related to rape and unlawful religious conversion of a Hindu woman to Islam. The petition, filed by Taufiq Ahmad, sought the quashing of the case based on a compromise between the parties involved.

Court Emphasizes the Seriousness of Unlawful Conversion

The court, presided over by Justice Manju Rani Chauhan, noted that the Uttar Pradesh anti-conversion law prohibits unlawful religious conversions obtained through misrepresentation, force, coercion, undue influence, allurement, or any fraudulent means. The law aims to safeguard individuals from deceptive religious conversions and to ensure conversions are voluntary and genuine.

Justice Chauhan observed that a settlement between the parties could not be a valid ground to quash criminal proceedings related to such a serious offense, especially when it involves unlawful religious conversion.

Bona Fide Conversion and Religious Beliefs

In her ruling, Justice Chauhan emphasized that a religious conversion could only be considered genuine if it resulted from a change of heart and an honest conviction in the new faith. The court stated that a conversion to Islam could be considered bona fide if the individual embraced Islam of their own free will, with sincere belief in the unity of God (Allah) and the prophetic character of Muhammad.

"A conversion of religion by an individual to Islam can be said to be bona fide if he/she is a major and of sound mind and embraces Islam by his/her own freewill and because of his/her faith and belief in the oneness of God (Allah) and prophetic character of Muhammad," the court stated in its order.

Implications for Future Cases

The court’s ruling serves as an important clarification on the issue of religious conversions under Indian law, particularly in the context of the UP anti-conversion law. It underscores the necessity for voluntary and sincere conversions, and sets a precedent for future cases involving conversions, coercion, and fraudulent conversions.

Background of the Case

The petition was filed by Taufiq Ahmad, who was facing charges related to rape and religious conversion under the UP anti-conversion law. Ahmad had allegedly converted the woman to Islam through misrepresentation. However, the woman later entered into a compromise with the accused, seeking to quash the criminal proceedings. The court, however, declined to do so, citing the gravity of the offense and the need to maintain the integrity of the legal process.
