5.4 This advertisement is being published subject to the Socially and Educationally Backward Classes Act dated February 26, 2024, and the relevant Government Resolution dated February 27, 2024, and the final decision in judicial cases filed in the Hon. High Court. The recommendations and appointments under this advertisement will be subject to Writ Petition No. 3468/2024 and other judicial cases at the Hon. High Court, Mumbai. The notification published by the Commission on April 26, 2024, will be applicable to this advertisement.

 

10. Stages of Examination: 10.1 The examination will be conducted in the following three stages:

(1) Preliminary Examination - 100 Marks

(2) Main Examination - 200 Marks

(3) Interview - 50 Marks

10.2 Details regarding the syllabus of Preliminary and Main Examinations, examination scheme, etc., are available on the Commission's website https://mpsc.gov.in.

10.3 Preliminary Examination:

10.3.1 Nature of Examination: Objective type multiple choice, one question paper.
10.3.2 Total Marks: 100
10.3.3 Medium of Examination: English

10.3.4 Syllabus for Preliminary Examination:

(1) Code of Criminal Procedure, (2) Civil Procedure Code, (3) Evidence Act, (4) Transfer of Property Act, (5) Specific Relief Act, (6) Maharashtra Rent Control Act, (7) Limitation Act, (8) Constitution of India, (9) Indian Penal Code, (10) Law of Contracts, The Sale of Goods Act and Partnership Act, (11) Bhartiya Nyaya Sanhita, 2023, (12) Bhartiya Sakshya Adhiniyam, 2023, (13) Bhartiya Nagrik Suraksha Sanhita, 2023 (BNSS).

 

 

10.3.5 Preliminary Examination Result: (i) To limit the number of candidates, the Commission will conduct a preliminary examination of objective multiple-choice nature. The results will be prepared based on a computer-based method. All candidates who score equal to or above the cutoff line determined by the Commission will be admitted to the Main Written Examination to maintain a 1:10 ratio against the advertised posts. (ii) If more than one candidate has obtained marks exactly at the cutoff line determined by the Commission, all such candidates shall be admitted to the Main Examination.
Clarification: If a candidate is included in the main examination, interview, or selection list of any previous ongoing recruitment process for the cadre of Civil Judge Junior Division and Judicial Magistrate First Class, and the same candidate is also eligible in the current recruitment process, the number of candidates for the main examination in the current process will be increased by the number of such common candidates.

10.3.6 Since the Preliminary Examination is a screening test, the marks obtained will not be considered for the final selection. Also, the marks will not be communicated to the candidates.

10.4 Main Examination:

10.4.1 Nature of Examination: Conventional (Descriptive)
10.4.2 Total Marks: 200
10.4.3 Question Papers: Two. Two papers of 100 marks each.
10.4.4 Medium of Examination: Marathi and English
10.4.5 Syllabus for Main Examination: (A) Paper No. 1: (1) Civil Procedure Code, (2) Transfer of Property Act, (3) Specific Relief Act, (4) Law of Contracts, Sale of Goods Act and Partnership Act.


 

(B) Paper No. 2: (1) Indian Penal Code, (2) Evidence Act, (3) Code of Criminal Procedure, (4) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Protection of Civil Rights Act, 1955, (5) Essay on Current Legal topic (Approximately 800 Words), (6) The Bharatiya Nyaya Sanhita, 2023, (7) Bharatiya Sakshya Adhiniyam, 2023, (8) The Bharatiya Nagarik Suraksha Sanhita 2023, (BNSS).
